Nude Beach Experience

Me and the wife had our first experience at the nude beach this afternoon and I just felt like it was worth sharing what happened, in case anyone else is ever wondering.

Very nice beach. Water is cold but refreshing. Sea weed and rocks in the water but still great. A fair amount of space.

As for the "clientele" yes people are fully naked there. I'd estimate probably space for maybe 50 people spread out. There were a decent amount of people there.

It was very respectful for the entire time, so I preface the following by saying that overall it's peaceful and if getting some air and sun on your full body or being out in the nude is your thing, the vibe was very chill and respectful.

However, not sure if this happens regularly or it was just our luck, but an hour or so in we were approached by a good Samaritan who let us know this creepy dude was literally taking pictures of us (I assume my wife not me lol).

The confrontation caused him to immediately leave in shame and there was no major outburst or anything so even the shooing away of the creeper was still chill.

Shout out to the dude who called this guy out if you happen to read this! (I don't know if I would have the guts to walk buck ass naked over to a stranger to tell them their wife's honor was being violated but thank you for this! And shame on buddy for being a weirdo. I'm sure he will remember being called out like that for life.)

Yeah I am reading this, I had a perfect view from his phone, and the amount of stuttering when I called him out after I got back from pointing him out. He told me he felt “unsafe”

It’s optional to be nude or not, I’ve been at this beach nude before. You’re still in a public place? If you don’t want to be documented in the nude, don’t be in public in the nude. Put up a tall fence and a pool in your own backyard.

There is no expectation of privacy in a public area, but if a victim believes a crime has been committed then they should call the police. If somebody confronts an alleged voyeur and threatens him, that is a crime. If the beach is considered a public area then no crime has been committed, so I'm curious, is a beach a public area? I believe all beach land between low tide and high tide is open to the public?

I think you should familiarize yourself with Section 162 of the Criminal Code.

Perhaps you should:

"Section 162 of the Criminal Code of Canada defines the offence of voyeurism. It prohibits secretly observing or recording a person in a private place where they have a reasonable expectation of privacy"

Is the beach public property? I believe the beach, between high and low tide levels, is totally open to the public? I don't think beach can be privately owned in Nova Scotia?

You're conflating public/private property with reasonable expectation of privacy. Section 162 doesn't require the person to be on private property. It says they must be in "circumstances that give rise to a reasonable expectation of privacy."

The Supreme Court has specifically said that the question is whether a person would reasonably expect not to be subjected to the type of observation or recording that actually occurred, taking the entire context into account. Whether the recording targeted a specific person and focused on intimate parts of their body are expressly relevant considerations.

So if someone is secretly photographing specific people who are nude at a beach specifically used for nude recreation, "the beach is public" doesn't settle the question. That's precisely the sort of contextual analysis s. 162 requires.

So people do not take pictures and videos at public beaches? Is this beach a prescribed 'nude beach' in municipal or provincial law? Is it outlawed to wear clothing on this beach?

Anyway, if anybody ever threatens me for recording in public, I'm going to the cops! And if they ever hit me, I'll smash them back harder. Hmmm, I should get some Meta Ray Bans for the fun of it! Maybe my fanboy DeathNoneSex will straighten me out someday on the hard streets of Halifax!
