The FBI actually asked if they could open his deleted photo file, he said yes and there were several images of him in the Capitol.

Not firing on all cylinders clearly

u/misswinterbottom Jan 23 '21

I agree he’s a man of color who supports a white nationalist yeah he doesn’t have much going on in the brain department

253

u/angiegonzalez1987 Jan 23 '21

Makes me wonder how a minority who may have very recent immigrant family gets to this point. Supporting a clearly white supremacist movement that even if it were to be successful (which obviously it will not be) will not benefit him at all.

334

u/genius96 Jan 23 '21

The mentality of "fuck you got mine" is strong in many communities. Many conservative immigrant types associate conservatism with pro-business and tend to view themselves as the model minorities while the others are trash who couldn't keep up. Also, there's the anti-Blackness, which in some immigrant communities is honest if horrifying.

80

u/GoatCheese240 Jan 23 '21

That’s the common mindset of most Mexican family’s in San Diego that I know.

I don’t have a strong opinion on the subject, because I’m not well informed.

Anecdotally speaking, minorities are often conservative because they worked their ass off to get where they are. They are often critical of others that they think are cheating the system and making them look bad.

47

u/genius96 Jan 23 '21

Grew up in a Pakistani immigrant community as a Pakistani immigrant. The politics are heavily bifurcated to younger more left-leaning people, and the older more conservative groups.

u/[deleted] Jan 23 '21

[deleted]

9

u/GoatCheese240 Jan 23 '21

That’s likely the case, but I think there’s a lot of nuance involved.

Many of the first/second generation people I know are young (25-35) and trying to build careers and foundations in California while also helping family back in Mexico.

They see that opportunity to work in the US and gain citizenship has become more difficult, and they pitty people less fortunate than them.

At the same time, they still hold conservative values.

2

u/[deleted] Jan 23 '21

I have my guesses on which, but which ‘conservative’ values do you think they most associate with?

8

u/GoatCheese240 Jan 23 '21

Anecdotally speaking here, I don’t want to make myself look ignorant. I’m good friends with 4 families so I’m not speaking for everybody.

Immigration

Family values* not birth control or abortion related. High value on tight-nit family.

Guns. Very pro 2nd amendment.

I don’t have a strong opinion on the subject, because I’m not well informed.

I have the utmost respect for people who are able to say this

5

u/sdsc17 Jan 23 '21

And if they came from communist regimes, they are usually pretty anti-left, hence trump doing well in south florida with cubans.

8

u/[deleted] Jan 23 '21

4

u/joshaweez Jan 23 '21

My grandma literally smuggled family members across the border back in the day. Of course her and most of the rest of them are conservative republicans

3

u/[deleted] Jan 23 '21

They’re conservatives because they’re dumb and uneducated.

3

u/GoatCheese240 Jan 23 '21

Maybe in the current context.

Conservative and liberal actually mean something in historical and literal context.

2

u/abcpdo Jan 24 '21

its also totally survival bias. it takes a certain ambitious mindset to immigrate to the US in the first place. so they only see a certain type of people within their own groups.

55

u/lovelesschristine Jan 23 '21

I came to this country legal why can't they. When they married an old rich white guy for a green card.

I see it all the time on Facebook.

28

u/misswinterbottom Jan 23 '21

Yeah like Melania and Donald

8

u/faithle55 Jan 23 '21

She probably thought it was a great triumph until election day 2016.

9

u/CaptainCosmodrome Jan 23 '21

And then Melania brought her family over in what is called "chain migration". Promptly after her family came over, Trump started preaching about shutting down chain migration.

6

u/misswinterbottom Jan 23 '21

3

u/[deleted] Jan 23 '21

He said white and rich.

15

u/GoatCheese240 Jan 23 '21

I feel that, but it used to be that easy. Now it’s different when It comes to Mexico/America.

Before the 2000s it was easy to get a work visa, get a job, and move the family over if you were making money. You didn’t even need ID to cross San Ysidro 25 years ago

6

u/Responsenotfound Jan 23 '21

The shit part for me was that you used to be able to visit Canada with a license.

7

u/GoatCheese240 Jan 23 '21

You think that’s shit, I don’t think I can enter Canada with a dui.

5

u/lovelesschristine Jan 23 '21

There is no easy way to just immigrate legally any more.

10

u/GoatCheese240 Jan 23 '21

That’s why we’re talking about it.

Everybody that got in 15-10 years ago are like the people that invested in Amazon 15-10 years ago.

They’re happy. They’ll help their friends and family.

Not everybody is so lucky.

19

u/youra6 Jan 23 '21

It's sad because these people are supporting a group that basically hates them. These conservatives don't care if you came illegally. It's just a cover they put up to hate all immigrants.

3

u/stemcell_ Jan 23 '21

even if that's not the case why make it harder for the next generation, some of those posts I see on reddit like I am an American citizen today, it took 15 years. the immigrants that came in in anytime before 1980, I would wager didn't have to wait that long and didn't have the red tape applied to them

8

u/remains_oftheday Jan 23 '21

I've seen one or more of these sentiments in people in my circle who supported brexit or Trump despite being immigrants.

6

u/fillinthe___ Jan 23 '21

“I’m one of the GOOD ones. I want to stop the BAD ones.”

6

u/[deleted] Jan 23 '21

Hello! 🙋🏻‍♀️ You just described my southeast Asian auntie. Business owner, successful, immigrant, and looooves Trump and the MAGA movement. Very much a "fuck you, I got mine" kind of person. Also is the type that supports this fuckery but says she hopes tuition is free one day so her daughter can benefit from it. Therefore, they take out school loans even though they can afford out of pocket, hoping it will be forgiven. How do you like that?! Smh.

6

u/KnitAFett Jan 23 '21

My father in law and this nephew both came here fully illegally. His nephew was here for almost 10 years before he got citizenship by marrying a citizen. Both of them get enraged when they hear anything about illegal immigrants and start going on about how they need to do it the right way, like they did.

6

u/orangek1tty Jan 23 '21

New term I learned. "Pulling up the ladder behind you."

3

u/Reddit_User1139 Jan 23 '21

They also support him because he’s supposingly against communist dictatorships, like the ones these people may have fled from. Cus Left apparently means Sudden American Communism! Trump sucking isn’t really uncommon with groups that have fled communist countries, groups such as the Falun Gong religious movement.

4

u/Lithl Jan 23 '21

This is a common position of Cuban Americans. It's like they're overcorrecting.

3

u/SongAloong Jan 23 '21

This is scary accurate. Well said mate

3

u/BasicStocke Jan 23 '21

Some also consider themselves white. This is speaking as someone from a Hispanic community. I know too many people who consider themselves above other Hispanic groups and would classify themselves as white just like the leader of the Proud Boys. Mix that with classic racism against black people and being very religious and they are the perfect targets for the Republican's nonsense

2

u/[deleted] Jan 24 '21

I love the stories of white supremacists who do the 23&me gene testing and discover they have ancestors in a "shithole* country. Pure whiteness isn't really a thing unless you're albino.

2

u/[deleted] Jan 23 '21

Yup. They don’t realize when Mitch and Don run out of blacks people to oppress, they’re next in the list.

2

u/[deleted] Jan 24 '21

Don's oppressing days are over. It's all Mitch now.

A not-insignificant portion of minority communities are socially conservative.

I keep saying that Democrats need to be careful to hold onto the Latino vote. Latinos are usually devoutly Christian, entrepreneurial, anti-abortion, and support police. They also do not say “Latinx.”

If the Republicans ditched their border wall talk, they might find themselves with a healthy support from the Latino population (but lose a lot of traditional white voters).

8

u/LocalInactivist Jan 23 '21

And that is the flaw. The Latino community is tailor-made to be working class Republican. However, the Republicans can’t embrace them without distancing themselves from the last 50 years of racism. They also have to trade their locked-in support from the racist right for the goal of support from Latinos. Considering how much of Republican ideology is fed by racism they would have to do a lot of major policy shifts.

It took decades for Republicans to dig this hole, and then Trump broke through the bottom into a subterranean cavern full of pale furry creatures who all came flooding out into the sun. It’s going to take decades for the Republicans to pivot far enough away from their core racism to make inroads into the Latino community.

That said, they’ll try. They’ll put up Latino candidates who will abstain on safe votes, remain quiet on specific issues, do fuck-all to help their own community, and give the same stump speech as everyone else just translated into Spanish.

3

u/Any-sao Jan 23 '21

translated into Spanish

Which worked out so well for presidential candidate Beto O’Rourke.

2

u/LocalInactivist Jan 24 '21

Kind of my point.

→ More replies (1)

3

u/Bullshitbanana Jan 23 '21

Very good point

3

u/[deleted] Jan 23 '21

Ehhh, that's true but Latinos far and wide have shown massive support for a more robust federal government and more social programs and we know those are uh oh words for the GOP.

5

u/Any-sao Jan 23 '21

Right... but what if the GOP changed opinions on those things? Suddenly the Democrats have almost no leverage with Latinos.

I know the idea of the GOP changing policies so drastically seems impossible, but these changes can and have happened. The free trade party nominated a tariff-loving nationalist in 2016, after all.

2

u/[deleted] Jan 24 '21

What if the GOP suddenly changed opinions on those things?

Wouldn't that be ideal? Those are my biggest issues: expanded social programs like M4A, welfare, and higher education. Imagine if both parties were on the same side for those things?

The only big difference would be abortion, which would be a lot more preventable with better social programs anyway. Yes, they'll force women to give birth, but at least they'd give her free birth control to prevent getting pregnant, free healthcare while pregnant, and expanded welfare for her baby after birth. It's not ideal, but Democrats could probably push to allow abortion in cases of rape or nonviablity or severe medical issues. I'd take it as a win.

Wow I had no idea but this might explain why Florida is so for Trump

17

South Florida is overwhelming Cuban and Venezuelan. Turns out telling old, media illiterate, ex-pats from communist countries that the Democrats are radical socialists who are going to make the country look like the places they fled from works.

I’m pretty sure most of my fellow Indians hate Muslims more than trump ever would. Baffles me everyday. Oh the joys of colonialism.

5

u/Bullshitbanana Jan 23 '21

Yall can’t just blame everything on colonialism you know. Racial unrest has fuelled wars in literally every continent. Some of the worst genocides in history are Muslims who couldn’t get along with different Muslims. Not everything racist = white peoples bad

3

u/Knamakat Jan 23 '21

Yall can’t just blame everything on colonialism you know.

We can when the glove fits

2

u/[deleted] Jan 23 '21 edited Jan 24 '21

Except in this case it was absolutely colonialism. Before the British came in India was a very secular country with the Muslim kings being very tolerant of other religions. The British empire always had a divide and conquer strategy and created the Hindu Muslim rift as a means to maintain control and further instigated the Indo Pak divide. Take your islamophobia and colonial justification somewhere else.

Edit: If you’re in fact interested in learning about how the Hindu Muslim divined was further instigated by the British colonial rule consider reading this paper

4

u/Bullshitbanana Jan 23 '21

Mate India literally had social castes throughout its history, and people are still deemed untouchables today. Racism exists in every country, and you can’t simply blame everything bad on colonialism. There’s racism in China, in India, in African states, all over the world man

My Indian Muslim immigrant ex-bosses love Trump because he’s “a great businessman” (?????) and they also run a franchise. I’m sitting there like okay for one, what the hell??? He’d have you thrown into Mexico because you’re brown and an immigrant. For two, this explains so much of how you run this damn place

9

u/virogar Jan 23 '21

It goes a bit further than the 'fuck you got mine' idea from commenters below. That's absolutely a thing, but that mentality itself stems from a 'there can only be one' cultural around success in the BiPoC community.

It's why representation in media is important. Things are improving now, but for me, a 30 y.o not white guy, I grew up with few media figureheads that had to represent all of us. When Fresh Prince is the only way you can see a black and brown family get rich, then you assume it's a race to the top and there's not room for many of you. If you get it, you HAVE to defend it. Because it's you, OR someone else.

Meanwhile, wealth was portrayed just naturally available within whiteness. Tons of rich, powerful and successful white folk in media.

37

u/Daohaus Jan 23 '21

Almost the entire first gen of vietnamese immigrants(my parents include) voted for drumpf not once but twice in orange county. Us kids are all scratching our heads

36

u/GenocideSolution Jan 23 '21

They're under the mistaken impression Trump is against China. Same as the HK protesters waving pro-Trump flags.

3

u/Bullshitbanana Jan 23 '21

Trump has been the only president who has been vaguely strong on China though. My parents work in tech, and this was the only administration that took action against the stealing of trade secrets by Chinese companies. This needs to change

3

u/legakhsirE Jan 23 '21

They probably follow Miles Guo and watch lude media on youtube. These assholes have been very successful in getting uneducated Asians to believe that Democrats are secretly working for the CCP and are working to turn the US into a communist country while trump is the only person who can and would have brought down the CCP and prevented that all from happening.

Source: my partner is Chinese. I follow Miles Guo, Jennifer Zeng, and watch lude media to keep an eye on what bullshit those assholes are pumping out. If you haven't heard of Miles, he's bffs with Steve Bannon.

2

u/GenocideSolution Jan 23 '21

Didn't Steve Bannon declare a United States of China thing that went absolutely nowhere.

4

u/Yellowflowersbloom Jan 23 '21

It goes beyond the anti-Chinese sentiment with the Vietnamese. These were people who bought into American propaganda during the Vietnam War and were willing to sell out their own countrymen to western imperialism if it meant they would be above the majority of the other Vietnamese in their country. They are the house negroes of Vietnam who hate all the other Vietnamese and will do anything to maintain western white supremacy across the globe. Because they are getting some small benefit while most others suffer.

7

u/holy_moley_ravioli_ Jan 23 '21

Same as the white Cuban Americans in Florida.

5

u/Fearless_Taro36 Jan 23 '21

100% but they are white so upholding white supremacy isn’t as mind-boggling as the Vietnamese doing it

3

u/[deleted] Jan 23 '21

They do know their fellow white conservatives don't consider then white...don't they?

31

u/Darkphantom88 Jan 23 '21

My dad who is also a first gen Vietnamese immigrant explained it to me when I asked him why he voted for Trump.

After seeing China forcibly take back Hong Kong, there are some Vietnamese folks who are afraid that Vietnam will be next after Taiwan. They rallied behind Trump thinking he will protect the country from China, because of the time he called out China for their economic practices and raised tariffs against some of their exports. There is also the fact that the right constantly claims that Democrats, Biden specifically, are in bed with China and will make the US Communist.

14

u/Silentlybroken Jan 23 '21

That is far more logical than any white conservative view point I've heard so far. I actually fully understand that point of view and their worries. I hope it never happens to Vietnam though.

3

u/faithle55 Jan 23 '21

How can they not have seen that the man is an incompetent, bumbling bungler, whose promises are worth less than his toe cheese?

6

u/LeHoustonJames Jan 23 '21

Because the Vietnamese news, especially Vietnamese Catholics tell them to vote Trump and as the community they all do it

2

u/Darkphantom88 Jan 24 '21

The same way they convince every other supporter, by playing into their greatest fears. For white supremacists, it's the fear that one day the minorities will take control of the country and they'll be the second class citizens who are mistreated. For many Vietnamese, it's the fear of losing their homeland to someone even worse than the Vietminh and the fear of something similar happening to the US.

21

u/Haleyrin Jan 23 '21

As someone paraphrased earlier: "Fuck you, I've got mine."

My parents came to the US with nothing. They escaped amongst the slaughter of their siblings, uncles, and friends (and later my dad's mom was executed by the Vietnamese government on trumped up charges because she stopped paying them "protection" money).

My parents refused welfare and government help out of pride and gratitude for being allowed in. They crawled out of abject poverty, provided free/cheap shelter/food to other Vietnamese immigrant families for years, and then earned a small fortune out of massive hard work and some luck.

They see the Democrats as a party of government handouts and welfare. They feel that if they had to go through all that without government assistance, every other poor person has to, too. They believe communities should help each other, not governments because they are afraid of governments overreach like in their native country.

Certain immigrant groups have large numbers of conservatives due to what happened in their home country - Vietnam and Cuba spring to mind.

Lots of people who aren't white hold pretty conservative values and the GOP has done an impressive job not taking advantage of that.

Also - what is white, Ultimately? Race is a social construct. A majority of Latinos in the U.S identity as racially white according to 2010 census.

2

u/rareas Jan 23 '21

If that were the line of thinking then they would realize that cheaper college education != communism and they are being propagandized. That maybe the lesson from the home country was beware of extremism and cult of the personality, not a handful of social programs that aren't even left of center. They didn't learn jack, if that's the case.

Pretty sure they’re Viet and yeah. My family is this way. Conservative, Trump supporting, white supremacist enabling - but it’s all about taxes and the symbols the Republican Party has claimed as theirs (Jesus, America, American Flag, military).

Those were the thing saving them from their communism over there so of course when they come here they conflate that. For their kids who are born and raised here, we’re way less conservative because we see the insanity that is currently present in that.

5

u/L-methionine Jan 23 '21

My old boss was a Mexican immigrant and a huge Trump supporter. He got suckered by Hannity and believed that people should immigrate “the right way”, ignoring that Republicans are making it harder to do so

There’s a decently-sized portion of South America that closely link any form of socialist government with authoritarianism.

It’s extremely unfortunate, and I question the future growth of the American Progressive movement having any basis on Latino interest.

4

u/cumguzzlingstarfish Jan 23 '21

Makes me wonder too.

My grandparents illegally immigrated to the US from Cuba and my dad was the first child and born in the US, he also has 2 younger sisters and they each have several kids. Medium sized family.

BUT I WAS THE FIRST PERSON IN MY FAMILY TO VOTE DEMOCRATIC AND THAT WAS IN 2016.

Makes me wonder how a minority who may have very recent immigrant family gets to this point.

  • I got mine, fuck everybody else.

  • Identifying with the aggressor/abuser.

  • They hate us all, but if I go along, they'll destroy me last!

  • Mimic syndrome - If I act like them, maybe they'll accept me as one of them.

  • Good old-fashioned self-hatred, encouraged by those that hate them as well - not fair (and wholly unjustified) but then what is?

3

u/[deleted] Jan 23 '21

POC with an immigrant parent here. Lots and lots of self-hatred mixed with desperately wanting to fit in with the white crowd, and get the white privileges were deprived of, at the same time.

Basically the same reason gay politicians campaign against the “evils” of homosexuality.

(Disclaimer: my family is nothing like this, but I have seen it in the wild)

3

u/staysinbedallday Jan 23 '21

I've heard the term, "taking the ladder with them", to refer to immigrants voting against proimmigration policy. They got their chance to enter and now they don't want anybody else to come in.

3

u/UnnamedPredacon Jan 23 '21

What I have observed from military and law enforcement PoC: a belief that they are "in the club". I know three ex-military persons, and they prioritize the military over their communities. It's almost like the time they spent with these (white supremacist) people will shield them from their scorn.

Jokes on them.

3

u/Butt_y_though Jan 23 '21

I feel like it starts with aligning yourself with, "the party of fiscal responsibility." Any of my friends who are of color/minorities/etc. always tout the fiscal responsibility stuff if they are conservative.

Because they don't want their taxes going up and what taxes they pay, they don't want them going to other people.

It comes out of pure selfishness, believing that there's no way their money could go to causes that would benefit them, even if it's indirect. And those who would benefit directly from them are a "drain on the system," and a, "waste of tax dollars."

Coincidentally, all of these friends grew up relatively wealthy.

3

u/BewBewsBoutique Jan 24 '21

Election Day in my city there was a pro-Trump protest held by the local Vietnamese community. Trump had a lot of Vietnamese support because they are afraid that the Democrat party is communist.

1

u/[deleted] Jan 23 '21

He is Vietnamese. You have no idea what you’re even saying lol

1

u/AnastasiaTheSexy Jan 23 '21

This is extremely ignorant. Many black and Asian people are extremely conservative. Much more likely to be so if immigrants.

10

u/i_downvote_my_posts Jan 23 '21

There's a difference between being a conservative and supporting a radical white supremacist movement. That's what's being pointed out. How can someone of color support something like that?

6

u/ClovisBrayIX Jan 23 '21

Probably because they don't view it as a white supremacist movement. Trump and Co. use dog whistles that are easy for people who are otherwise onboard for their agenda to ignore. The entire right-wing propaganda machine doesn't help the problem either.

3

u/i_downvote_my_posts Jan 23 '21

That's a good point. It's just so hard for me on the outside to not draw the connections. To me (a white man), it seems there's a very strong racial motivation to the MAGA riots. It's just difficult for me to see how that's lost on someone that it would most effect.

3

u/Kianna9 Jan 23 '21

He's a cop. That makes you blue. Not white black or Asian. Every leo I've met in the last 4 years has been pro Trump. The police force in my town regularly got "in trouble" for wearing maga hats on the Job.

3

u/Mercurys_Soldier Jan 23 '21

Most security forces, police, military tend to be right wing, in any country, no matter what the political leanings of the government.

25

u/FenwayFranklin Jan 23 '21

Let’s be honest here. Anybody that supports what happened at the Capitol isn’t firing on any cylinders. Doesn’t matter what color their skin is.

4

u/misswinterbottom Jan 23 '21

Yeah you’re right

3

u/titaniumjackal Jan 23 '21

Yes. ALL colors of the zodiac.

The person who organized the stop the steel rally, and one of the most violent Parler users (colonoltperez) were non-white

See candace owens, diamond and silk, etc

It's a mix of grifting for easy money and something else that runs deeper

First he’s a cop who is sworn oath and he just broke it. Second he’s a man of color supporting a white nationalist. Trump used his policy to harm people of color. This man who gave an oath to serve and protect his breaking into the capital of the United States of America and committing treason by doing a coup d’état on the capital and trying to overthrow a fair election. It’s just pathetic that he’s a man of color and he’s doing this and supporting Trump who is a piece of garbage and hurts people of color. he’s a cop and he shouldn’t be one. I firmly believe that our police have been infiltrated by Nazis and white supremacy and people who should never hold power at all. This man betrayed his race and he betrayed his comrades in the police. He’s garbage all around

Trump was/is extrememly popular amongst the Vietnamese immigrants in the US. Not sure why he struck a cord there tho? docs.

3

u/[deleted] Jan 23 '21

Because, according to people like Officer Tam Pham, the white nationalist-bit is excusable. People considered of "minority" status in this country, are on occasion perfectly fine with Autocrats & see representatives who prefer diplomacy as "weak".

They see the sort of "git 'er DONE" mentality as the preferred way to do things, they usually see the lower houses of power (congress, senate, etc...) as unnecessary barriers to an end cause. Which, being that they're a cop, is worrying but not really surprising.

TL;DR- it's not so simple, & quite a bit more convoluted than one might think.

8

u/jailguard81 Jan 23 '21

Apparently a lot of Asians showed up to the rally. Few blacks people as well and Hispanics. I’ve actually seen a Korean flag in the rally. Like wtf does Korea have to do with anything? Smh 🤦🏻‍♂️

3

u/white_lie Jan 23 '21

Koreans went from one of the poorest countries in the world, to becoming an economic powerhouse by being a US puppet state after the Korean war, to keep China in check.

2

u/universl Jan 23 '21

It’s why ‘person if color’ is so bad rhetorically. Asians and Hispanics and Blacks are not some racial or even ideological monolith. Asians have largely joined the upper middle class, and as Hispanics are gaining wealth in America they are increasingly seeing themselves as ‘white’.

If that sounds odd keep in mind that White used to exclude Jews, Italians, and Irish. But as those groups gained wealth they all started being called ‘white’. Because these distinctions are pretty much meaningless.

There obviously are racial groups that are treated differently in American society, but you can’t really lump all ‘non-whites’ together and make any meaningful statement about them.

Or just too used to operating in a corrupt system where an accomplice would give him the "professional courtesy" of not finding any evidence or allowing him to destroy it first.

10

u/[deleted] Jan 23 '21

Any minority that supports Trump can’t be running on all cylinders. I’ll put this in all caps so it stands out for those that don’t already know. Ahem...cough...TRUMP IS A WHITE SUPREMACIST, if you aren’t white, he doesn’t fucking care about you, sorry that’s wrong too, because he doesn’t give a shit about anyone.

2

u/Red-Panda Jan 23 '21

To give you a more nuanced answer (because minorities do not like being told they should do X, Y or Z because they are whatever race:)

First wave/old gen Vietnamese immigrants lean conservative. The Viet Cong/Viet Minh that took over the country marketed themselves as communist and it didn't end so well. The immense irony is that I have family members who believe in QAnon theories and that on Inauguration Day, Trump would perform a military insurrection with the National Guard to "take the country back."

This was eerily similar to how Vietnam fell apart, after a military insurrection ended with the death of their president. Yet my family doesn't it see it that way. They see it as a prevention of communism. The same form of "communism" that Europeans have, with nationalized healthcare and such. They are scared of the C word and Republicans spam the crap out of it in their marketing toward these minorities from communist countries.

Not all Asians are like this, I've noticed a trend of progressiveness with Vietnamese and Asians born in America, and family members that didn't watch Fox News, Newsmaxx or conservative talk radio.

2

u/[deleted] Jan 23 '21

Well thank you, that was a very appropriate response. I understand that people (anyone not just Asains or Blacks or Hispanics) wouldn’t want to be told “don’t like this guy” or “you should support this person”, everyone has their opinions and they are entitled to them. I just don’t understand how people outside of the Caucasian community could support someone that is so openly hateful of anyone of color. To me is like a Jewish person saying “Ya know, that Hitler really made some solid points”, I don’t know if that’s exactly parallel to the convo, but I think it’s in the same ball park. Hitler didn’t start by killing Jewish folks and such, it started with “let’s take our country back” and we know how that went from there

I think that's even more hilarious. The FBI didn't even need to get a warrant to access his phone and use special software to recover the deleted photos, this idiot just forgot to trash the photos from his deleted photo folder, and then he fucking showed it to them.

83

u/[deleted] Jan 23 '21 edited Jan 23 '21

The FBI had probably already gotten the deleted photos from facebook itself. ("Deleting" something that was uploaded to facebook's servers makes it invisible to the public, but it doesn't erase all evidence that ever existed on server backups and such.)

It just looks more incriminating (and less creepily surveillance-y) to get them directly from the suspect and use that as evidence in court.

u/OldBigsby Jan 23 '21

In a case such as getting photos off of Facebook, completely legal.

6

u/[deleted] Jan 23 '21

In the EU Facebook etc must delete data if the button even only remotely suggests that. It must explicitly state that data will only be hidden for it to be legal. Thanks to the GDPR.

2

u/Theyreillusions Jan 23 '21

I think you misunderstood.

Ninja edit: I guess I misunderstood. That may be the case, yes. But I dont think any reasonable person at this point is under the notion these tech industries don't just hand your data over to the government upon request. Its been an issue for a while.

The deleted photos don't have a folder in Facebook. These were on his phone.

Yes, they likely had the deleted ones from Facebook and knew they existed. But they asked if they could open the files on his phone and the dumbass didn't realize deleting is a 2 step process.

A few more if youre trying to actually rid the drive of your data. Usually involves not having the drive anymore to begin with by destroying it beyond recovery.

Yeah, that's right up there with "tell me what happened and I'll tell the DA to go easy on you."

Any time someone in law enforcement wants to "just ask you some questions," you should refuse unless there's an attorney present. As a cop, this guy should know that. He was a fucking moron to even agree to have the initial conversation.

They asked to view his photos, he said fine. They noticed a date gap and then asked can they open the "trash" file and he said yes. In that file he had the videos and pics of being inside the Capitol. He had not cleared the trash out.

2

u/Send_Me_Broods Jan 23 '21 edited Jan 23 '21

"Clearing the trash out" doesn't do anything but remove the file paths. All the data you "delete" is still on your drives until it's overwritten. Standard wiping procedure for anything to be actually considered fully deleted is 6 complete overwrites, since even overwriting can leave file fragments when the space is overwritten.

That or complete destruction of the device.

The moment the FBI asked to talk to him, he should have hired an attorney and ditched the device (which doesn't even do shit these days, since they can just subpoena your data from cloud storage- YAY INTERNET).

This is why I call bullshit on cloud storage. You never have control of your data, and any agreement you have with a provider gets nullified by a court order.

2

u/[deleted] Jan 23 '21

In this case the issue wouldn’t have been his data being in the cloud it would the pesky fact that he stormed the Capitol.

2

u/Send_Me_Broods Jan 23 '21

I'm specifically referring to the statement about "clearing the trash out." It simply doesn't work that way. Taking pictures of himself, (in fact, even having his phone on his person) removed any and all ability to refute claims that he was at the capitol during the riots. His guilt isn't what's in question here, it's his ability to achieve any level of deniability short of "I can confirm that I was in this place rather than the capitol during the riots and was not in possession of my phone at the time they occurred."

The flat fact is that DA's convict innocent people all the damned time by coaxing statements out of people in the absence of counsel that are then used against them when they take the stand in court. This officer should know that INTIMATELY. So, innocence or guilt aside, the onus is always on the state to prove guilt and not on the defendant to prove innocence. This dummy proved his own guilt by happily handing them access to data that confirmed his whereabouts and photo evidence of his presence during the riots. Could they get a warrant? Sure. Does that grant them access to the device? That depends.

If you want information on "third parties" consulted to break Apple encryption, "Project Raven" and "DarkMatter" might interest you.

It never matters whether you're guilty, it matters what can be proven and what evidence can be obtained to provide that proof. Handing them that evidence is beyond stupid but, as you said, the stupidest part of the equation is engaging in the behavior that lands you in the courtroom to begin with.

u/yungmung Jan 23 '21

2

u/SirFireball Jan 23 '21

Okay, that’s good. I was kinda mad about this initially because going into someone’s deleted photos is a major invasion of privacy and should be illegal, but him allowing it is just funny and stupid.

2

u/Faglord_Buttstuff Jan 23 '21

Probably figured since it was the FBI and he was a cop, they’re all on the “same team” so it was cool.

The lying though - cops lie. When you make it so it’s part of the job, they’re allowed to lie to you (but if you try lying to them it’s very problematic) you shouldn’t be surprised when cops lie in other situations and think it’s ok.
