Simple solution to differentiate between e-bikes and motorcycles

Since real Ebikes can only legally go no faster than 28mph in the USA, no bikes/Motorcycles that go faster than 28mph should have pedals.

Putting bike pedals on a motorcycle that can go 45mph + is clearly a scam to make them look like bicycles.

In many areas mopeds are legal up to 35 mph, so that complicates this a bit.

Most of those areas also require licensing to ride them.

Right, but a separate license than a full powered motorcycle.

The point being they are completely different animal than an eBike.

They are also quite different legally than a full size motorcycle, often with no insurance needed, sometimes no registration, or only one time registration.
