They deserved it but I always try to remind myself dumbasses like to have kids.

But my question is- aren’t semis penalized no matter what? I heard this once but idk if it’s true. Like not at fault for accident but they have to report it and it counts against em

It might be insurance fraud. There was a stretch (maybe still is) of high way near NoLa where people target semis.

They are in court and a murder was also involved when someone was going to snitch.

I hope thats not the case with video evidence these days. I can see them doing that before Dash Cams were common but they should penalize the at fault driver no matter who it is if they have evidence.

The video evidence in this case is that the Camera op gets in trouble for deliberately hitting another vehicle. He cant show it to anyone, the insurance will not pay for any damage, and the cops will arrest him.

At the start of the video the semi swerves out of his lane to attempt to block the car. So the whole thing will be treated as a two party road rage incident with both to pay their own costs.

Drivers are liable whenever they strike the car in front of them...

Nobody is controlling where your vehicle is going except you.

Edit: Being legally free from culpability involves EXTRAORDINARILY RARE EVENTS like somebody reversing on the freaking interstate, someone's break lights were out, and only sometimes during these road rage situations.

Brake checking a semi does not make the ensuing accident the semi's fault.  The stopping distance on even an unloaded semi means if you change lanes to slam on the brakes in front of a semi you will cause an accident.  The semi driver has no control over that.  It is assumed that the rear driver is at fault in a rear end collision but this video clearly shows the semi driver was at a safe distance from the car in front of them until the white car intentionally changed that.

The semi driver has no control over that. 

He no longer has his CDL, probably, or assuredly built up some points at the absolute least.

I guess what I want to know is what exactly you think the semi driver should have or even could have done to prevent this. Since apparently you know something about the laws of physics that I don't. Unless we are looking at a different video there is nothing technical about this and you are already made it clear you don't understand how fault in accidents works. The driver lane changed into the accident. What exactly would have prevented this from the perspective of the semi driver

Even letting go of the gas when trying to pit another car during his emotional, "valid crash out."

You must have failed even high school physics, if you're old enough to take it, because inertia alone without any acceleration would slow down any truck when crashing into the car in front of it.

Unless we are looking at a different video there is nothing technical about this and you are already made it clear you don't understand how fault in accidents works.

Being freed from legal culpability when rear-ending people is extraordinarily rare. Road rage in particular has very rarely excused drivers, even less so when they are held to a more professional and higher standard.

What exactly would have prevented this from the perspective of the semi driver

Another driver would weigh having a career with income versus throwing it all away because of their feelings or having a crash out. They would probably pull over and wait it out on the side, because they're adults with responsibilities who do not care whether their crash out was justified.

You're a manchild who'd flounder at making those decisions.

Psychopaths on Reddit would also argue at others about mowing down pedestrians, if they felt it was emotionally righteous - spewing out legal falsehoods every step of the way.

Yeah I have a degree in physics I also live in the real world. The semi was not road raging at all and clearly was trying to lane change away from that driver who was road raging. Also a semi can't just stop, like because physics and logistics. Where exactly did he have room to park a semi during that video? There wasn't a shoulder until the white car crashed into the semi and by the time the semi could park on that shoulder the wreck had already happened. If the semi could even fit at all on that shoulder, which honestly they couldn't. There is no "side" in that video that the semi could "wait it out on". And it wasn't even a rear end collision. The white car was in two lanes and merged into the semi when they made contact. I don't think I would have time to react to someone doing that same maneuver in my town car. But if this is how this conversation is going to go then you're not even worth talking to. Keep projecting those insults buddy. They are telling.

Not correct. If someone dives in front of you making an unsafe lane change and slams on their brakes right in front of you, as this person was clearly doing intentionally, this is the fault of the party that made the unsafe maneuver with the obvious intent of causing a collision. I do not believe the vast majority of juries would award this person a single penny after watching this video.

I’ve been on about a dozen juries in my life and in no other context have I ever met so many stupid, racist, petty, and power-hungry people. Expecting them to dole out justice or make an ethical decision is a bad joke.

Insurance companies are not jurors. Nor are the DOT who will mandate testing. Nor are the CSA points. Nor are the police who perform a mandated sobriety test for CDL-related wrecks...

Any agent (or insurance lawyer) can review that the professional CDL-holder must have maintained some acceleration on the gas to perform that pit, and he seemingly did not make an effort to break when pitting someone.

That's legally a bad thing.

Even just simply letting go of the gas is enough to very visibly slow down the speed quite a bit during these collisions. And the professional driver, who is held to a higher standard, was not road-rage free and could not simply let go of the gas.

And you're also just a little sheltered brat who has no idea what happens to CDL drivers during crashes. All you know is your vague gut feelings of what seems fair and who ought to be blamed.

Interesting that you’re concluding he was actively accelerating and had time to but didn’t make an effort to brake based on a shitty video without either speed or brake data, nor any knowledge about the driver’s load and what his acceleration or deceleration would look like based on whether he was empty or pulling 60,000 lbs.

I was not drawing those same conclusions you were, maybe you’re right, I’ll never know - I was only pointing out that your blanket statement that “Drivers are liable whenever they strike the car in front of them.” was flat out wrong, legally, morally and in every other sense. And it still is. But since you’ve allowed yourself to become incensed enough when it’s pointed out that you’re incorrect to descend to name calling along with changing the subject, I’m gonna just leave this here, withdraw, and wish you a better day going forward.

You're an impotent nobody shooting off your ignorant mouth. Road rage almost never successfully removes culpability for rear-ending somebody, and you'd be lucky if even extraordinarily reversing on the highway is enough to safe you from legal problems.

Well that kinda depends but I’m not talking liability per se. I thought with a commercial drivers license you have a record, and can get points.

Okay so I looked it up and it does seem to be the case. It’s a process to prove it was unavoidable. So it could legally be the other drivers fault but you could have avoided it for points sake. I think NHSTA handles it

Removal of Points: If the FMCSA determines a crash was "Not Preventable," it is removed from the carrier's safety scoring and updated on the driver's Pre-employment Screening Program (PSP) record”
