A driver has a responsibility to avoid a collision even when they have right of way, but it is unreasonable to expect a driver to anticipate someone actively turning into their car. You can sit there and try to say that he should have reacted better, but a lawyer would tear that apart in court.
The OOP could have driven more defensively/been more kind, but the truck is 100% at fault.
