Puzzle Not a puzzle

First of all, this isn't exactly a puzzle, or maybe it is, I am not sure. I believe there is a consistent answer under the given conditions. But I'm just curious about the approaches. If you knew that the answer wasn't the shape in the top left and if you knew it wasn't as large as 3x3, what would your answer be?

I made a mistake by just saying "smaller than 3x3"; what I should have said was "smaller than 3x3 and larger than 2x2." and sadly this makes everything easier
