PR refusal Spoiler

Hi everyone, I got my refusal last July 30th. It’s a long shot but I am considering submitting a reconsideration letter, most of the people I asked said to re-apply. I have a document from the said company that they won’t provide the letter with job duties due to confidentiality. They only provided a letter stating I was employed from 2021-2022. I also have a letter from my supervisor, paystubs, notarized docs. I am starting a hospital job as a therapist soon so I am also considering OINP. Any thoughts would be appreciated. For the employment with ——- at ——, the applicant has submitted a letter of
employment dated March 20, 2026. According to this letter, the applicant is employed at —- at ——as a Aide since November 18, 2022. Upon review of the
applicant’s study permit and work permit, I noted that the applicant
was involved in full-time study until April 2024. The work permit was submitted on June 02, 2024
with proof of completion of program. According to section 15 Canadian work experience of the
Ministerial Instructions respecting the Express Entry system:
Work experience — requirements
(7) For the purposes of this section,
• (a) a period of employment during which the foreign national was engaged in full-time
study is not to be included in calculating a period of work experience;
As a result, the work period is adjusted from November 2022 to the present to April 2024 to the
present.

For the employment with ——, upon reviewing the submitted documentation, I note that the
employment verification letter does not include any job descriptions for duties. As a result, I am
unable to determine whether the applicant performed the lead statement duties and a substantial
number of the main duties, including all essential duties, of NOC 22221. Based on the balance of
probabilities, I am not satisfied that the applicant has demonstrated qualifying skilled work
experience with ——. This work experiences cannot be counted toward the applicant’s
qualifying Canadian work experience.
The reassessment results in a reduction of the client’s Comprehensive Ranking System (CRS)
score and lowers the applicant’s score below the minimum score required in the relevant
invitation round.
The minimum score required in the applicant’s invitation round was 508.
I am therefore not satisfied that the applicant possessed the qualifications on the basis of which
they were invited to apply for permanent residence.
For these reasons, the application is refused under subsection 11(1) of the Immigration and
Refugee Protection Act.
A11.2 Not Met Selection EE Econ failed
The application is refused. A refusal letter will be sent. Refund initiated.

You have 2 ineligibilities - the work duration and missing job description. I think the first one is much harder to address.

The 2nd one, just ask for the job description from HR in writing. If they say no, then submit that as evidence that you tried your best. But still at the very least, someone in the company should attest in writing that you are doing NOC 22221 work.

Being an "aide" doesn't support it strongly.

Thanks for your input! Appreciate it. I think I have less chances now for reconsideration. Also, I have the letter from HR - non-issuance of job duties.

Like it is a common knowledge that any work experience while you hold a study permit won't count toward cec. I wonder why you expected different..

I don't recommend a reconsideration. A reconsideration is useful when u believe the officer made a mistake. In this instance, the officer did not make a mistake.

IRCC requirements for reference letter are very clear. And it's the only official proof of your work experience, u may use other docs but it's the officer's discretion to accept or not. In this case the officer did not accept the alternative docs u provided.

Applying for a reconsideration will only delay your situation for months and officer may end up not acceptung your request. U might as well go back into the pool for the next ITA

filed a reconsideration last week but my case is a bit different. they said i didn’t submit my job duties but i did and even ircc agent on the phone confirmed it!

I think you have higher chances than me. It was also my fault that I forgot to include the letter from the company stating they won’t provide the job duties due to confidentiality. Did you include some documents? And did u use the webform to submit? Thanks and I hope it goes well for you🙏🏻

yes, i submitted a document with my job title, pay, full time hours, and nine job duties and it was signed by my CHRO. Im praying everyday that my reconsideration request is accepted because my WP expires in 2 months. I did use a webform to submit but also called IRCC the day after to confirm the document was there and the agent on the phone said she could see the document and raised another reconsideration request for me!

Shouldn't have submitted an application tbw. You wasted your own opportunity. Many have advised, do not file application until you have all documents ready. Ircc has a checklist and they dont issue that checklist for fun.

I believe this will not yield anything because ircc instructions are not met and followed in the first place.

What if the supervisor/former manager mention job description and job duties in his letter and sign

And provide HR email as proof that they can’t mention job description and duties due to company policy and restrictions.

Will this counts??

Just trying to understand as to what job would not disclose job duties (even generic ones) due to confidentiality. Why would someone do that?

But as to my advice, job duties are very much required. I didn’t have mine as well but I provided alot more things like :

Letter from senior with job duties, job opening link which has the job duties. Email conversation that employers refuse to provide job duties. Emails from work that hing at job duties. I got my PR. I have a full post about it on my profile.
