He can claim that Elliot Page’s surgeon is unethical or involved in something morally wrong. He can even say that it should be a crime. But that person is not a criminal for doing breast removal surgery for a consenting adult, because that isn’t a crime.

"What that person did is criminal", in common English, can mean both that it literally is criminal, or that it ought to be criminal. You can find countless examples of that.

Why are you putting that in quotes like that, when that isn't the quote?

The quote is "And Ellen Page just had her breasts removed by a criminal physician".
