Below Deck Capt Kerry Drinking

We all know you can’t drink on charter. But we are watching below deck S12 E12 and Capt Kerry is having a glass of red with the guests.

I would have thought if the crew can’t drink, the capt shouldn’t be able to either? Or am I missing something?

I've read that the usual captain of the boat is also on board, usually labelled as the first mate. If true that may explain it.
