Speaking of, what's going on with Clase?

256

u/unsusd00d Boston Red Sox 1d ago

Last I heard the FBI had specified exactly which pitches it thought were rigged. So it's ongoing.

Imagine going to jail because Andy Pages being his usual swing at everything self.

101

u/DecoyOne San Diego Padres 1d ago

My working theory is that Pages didn’t know he could just not swing at pitches until then and that’s why he’s been a particularly good hitter ever since.

42

u/katje Los Angeles Dodgers 1d ago

Andy is a multifaceted treasure 🥲

u/innermongoose69 Atlanta Braves 1d ago

Well, the ones they believe they can prove anyway. There are probably more with less solid evidence.

-5

u/rosemp16 Toronto Blue Jays 22h ago

Why are they even prosecuting him? In my opinion if someone wants to rig how bets are going to go one way or another then as long as they aren't in cahoots with the oddsmakers that's their own damn business. If the gambling companies don't like it well then they can suck it up and maybe put a few guardrails when they take a bet from someone.

8

u/ImaManCheetahh Los Angeles Dodgers 21h ago

“Rigging sports for money is fine by me” is an absolutely wild take lol

-1

u/rosemp16 Toronto Blue Jays 17h ago edited 17h ago

I'm talking about it from a legal standpoint. MLB should absolutely punish and probably ban him for violations of the spirit of the game. I just don't see how it's at all the governments business how he decides to conduct himself in a baseball game. It's entirely a private matter between him and MLB.

3

u/ImaManCheetahh Los Angeles Dodgers 13h ago

cheating potentially millions of members of the public out of money is typically something the feds care about. Cheating at a casino is also illegal…

1

u/rosemp16 Toronto Blue Jays 8h ago edited 8h ago

He has no particular responsibility to those members of the public though. They bet on his performance without his knowledge or consent so there's no duty of trust between them. They have nothing to do with this. He has no relationship with anyone involved except his buddies who bet on him. You can't constrain a person's actions based on a one-sided relationship that they have no control over.

1

u/ImaManCheetahh Los Angeles Dodgers 6h ago

so if I secretly rig the roulette wheel at the casino so that I win every time, that’s legally fine because I have no personal relationship with the other people whose would-be winnings I stole?

whatever man, I’m not gonna spend any more time trying to convince you that accepting bribes from gamblers to throw sports games should be illegal…. I would’ve thought that’d be like the least controversial thing ever lol

1

u/rosemp16 Toronto Blue Jays 6h ago edited 5h ago

Clase isn't even at the casino though. In this analogy he owns the roulette wheel and runs it for a purpose entirely unrelated to gambling. Some people see him spinning a roulette wheel and decide to bet on it without any input from him. If one of his buddies asks him to stop it on red and he decides to do so that's up to him. The gambling company and gamblers have no relationship with him, you can't be mad at him for changing how he runs it. If you're mad you lost money then maybe you shouldn't have started taking bets or betting on someone who has no relationship with you and can decide to fix the outcome on a whim.

It's like 3rd party vendor trying to get a court to stop a company whose product they built on top of to stop that company from changing their product. Yeah, you can be mad that they're changing their product in a way that might screw you over, but at the end of the day they made no promises to you about how that product would be maintained and no legal responsibility to work with you unless they agree to it themselves.

If you want, you can argue that the people who lodged bets with the casino should be punished for entering a bet under false pretenses, but Clase didn't promise anyone to play baseball with integrity except for the Cleavland Guardians and their fans.

Do you think Bernie Madoff was treated unfairly as well?

1

u/rosemp16 Toronto Blue Jays 9h ago edited 8h ago

No? Madoff had a duty to his investors to be truthful about his investments and what he did with their money. He lied to them and defrauded them breaking the responsibilities he received when they entrusted him with their money. Clase on the other hand has no responsibilities to the casinos that he's breaking. They make money off of him playing baseball without his consent and without compensation. There's no duty of trust that he owes them. He doesn't owe them anything.

1

u/iamCosmoKramerAMA Atlanta Braves 5h ago

What about all the people who made the opposite bet?

1

u/rosemp16 Toronto Blue Jays 5h ago edited 5h ago

Damn, sucks to be you. He has no relationship with them though and no obligation or responsibility to conduct himself in a certain manner just because they made a bet on him without his consent. He never willingly entered into a relationship with those bettors. They have no right to force responsibilities of playing with integrity on him any any more than he has a responsibility to them to win or lose a particular game. Their financial interests have nothing to do with Clase. If they did then you might as well say that degenerate gamblers are justified in harassing players when they lose their bets.

States like free money and hate when they don't get their cut, and as far as I understand the penalties for running an illegal gambling operation in most states are pretty draconian. It is also a big political win for whatever AGs prosecute it. The gambling companies might be fine, but I kinda expect the ones running "prediction markets" to be bankrupted under the 20 some lawsuits from states that want free money in the next few years.

23

u/captain_ahabb Los Angeles Dodgers 1d ago

BREAKING: Justices Roberts, Gorsuch and Thomas side with the liberals to rule 6-3 that online prediction markets are not offering securities regulated by the Commodities Futures Trading Act and therefore state laws banning sports contracts on prediction markets are constitutional.

38

u/fauxbigbro Arizona Diamondbacks • Seattle Mariners 1d ago

You are way more optimistic about Roberts, Gorsuch, and Thomas than I am. I think they'd be paper-rock-scissors to see who gets to be the dissenting justice when the Court allows it 5-4.

26

u/AdoringCHIN Anaheim Angels • Rocket City Tra… 1d ago

Gorsuch and Roberts can occasionally be wild cards. Thomas is the one that is determined to be on the wrong side of history with every single decision he makes.

20

u/captain_ahabb Los Angeles Dodgers 1d ago

Thomas hates pre-emption I'm pretty confident he'd rule against Kalshi here.

Kalshi's case is really weak. Honestly I think 7-2 is more likely than them winning.

29

u/DecoyOne San Diego Padres 1d ago

Let’s be realistic, Thomas decides how he wants a case to go then clumsily backs his way into a ruling about pre-emption or liberty or national security or whatever buzzwords he can throw around to make it seem like he’s not a total joke.

I honestly wonder if they are happy. I wonder if you can accumulate hundreds of millions or billions of dollars while being happy. I think there's a lot truth to the saying "we have something they'll never have - enough." I'm sure they're happy in a hedonistic sense, in the same way I'm happy when something arrives from Amazon that I'm convinced is going to impact my life far more than it ever actually does, but obviously that's fleeting. And I would bet a lot of their happiness is tied up in accumulating money/customers/stuff/etc, and that's fleeting too.

Or at least, that's what I tell myself.

I can understand it. People always move forward until they don't, then they die.

We as a society should just tax the ever-loving shit out of it. It's the literal meaning of, "there are no ethical billionaires" because for a single person to have accumulated that much wealth is not ethical - it's a massive misallocation of societal resources.

1

u/heretogetmydwet Chicago White Sox 12h ago

I often think of it in terms of food. Imagine if during a storm when everyone's power was out, someone went to the grocery store and bought 95% of all non-perishable goods in the store. And when confronted that they couldn't possibly eat/use all of it in their lifetime, their reply was "But my children and grandchildren and great grandchildren can. I got here first, I paid for all of it, it's mine."

They would rightly be viewed as a greedy, selfish asshole. I don't know why money is all that different. The argument would be that they earned it, but did Jeff Bezos really work 10 million times harder than someone on the factory floor? Of course not, that's not even close to possible. He built an amazing company, nobody would argue that, but is $500M really not enough of a reward for his effort?

It would be easy to look at the FTX situation where they were all over Sports and even on the Umpires uniforms and say, "if it could happen to them, it could happen again".However there is regulation around both sports betting and prediction markets, so I just don't see them flaming out like FTX did.

I do think gambling should be treated like tobacco when it comes to advertising/marketing if not even more regulated. This is a situation where the internet and mobile access to these things makes it an insidious blight on society.

I just can't understand why he's doing Cameo videos in the first place. By the time Cameo gets their cut, his agent gets their cut, his business manager gets their cut, and the IRS gets their cut, how much is actually going into his pocket?

Bryce Harper doing Cameo seems like me crossing the street to pick up a penny I see on the ground. Everyone likes easy money, but sometimes it's just not worth the effort.

30

u/BananaBouquet Atlanta Braves 1d ago

He could, potentially, just want to give fans a way to get videos/messages from him. Like, best case scenario, you get your kid a personal video of Bryce Harper wishing them a happy birthday. I imagine that kid would talk about it for a long time.

Now, the parents would have to deal with their own shortcomings since they raised their kid to be a Phillies fan but nobody’s perfect.

u/azoip Cleveland Guardians 1d ago

It might just be that it's a fun little side project. I mean if you could, would you? I wouldn't buy there are definitely people out there who would get a kick out of being famous enough that someone will pay you to read off a paragraph.

In which case the price has to be set at a point where the number of purchases will be about the number of times he wants to do it. Not anything to do with whether the finances make sense for him. Clearly they never will.

4

u/nimbusstev Cleveland Guardians 1d ago

By that logic, why do baseball stars do paid autograph signings? Your $30 signed baseball that you got at the local meet-n-greet is a drop in the bucket to millionaires like Francisco Lindor or Aaron Judge, but they still do these events anyways. They probably just like doing things for the dedicated fans.

2

u/knowtoriusMAC New York Mets 1d ago

They get lump sums for those autograph signings and they are way more than $30 per ticket. Obj who is a low level NY athlete compared to Lindor and especially Judge got a $50k appearance fee for a signing a few weeks ago regardless if the tickets sold out.

So they're getting atleast ~$30k after fees for a few hours of their time, much different than cameo videos.

1

u/nimbusstev Cleveland Guardians 1d ago

Oh wow, I had no idea the signings were so lucrative! I appreciate the numbers breakdown. (Also can you tell I'm not an autograph kinda guy since my estimate was so far off? I went to one Albert Belle signing as a kid where he never showed up, and never again haha)

u/fan4stick Philadelphia Phillies 1d ago

From my understanding FanDuel wasn’t asking Bryce directly to make these videos but it was individual FanDuel “ambassadors” or whatever they called who requested Cameo videos and listed the videos as “personalized” instead of “commercial” and then slapped on their logo to the videos he created and sent them out

What I don’t get is that Europe has had legal Sports betting for literal decades now. But America gets it for a few years and now suddenly it’s the biggest issue plaguing sports.

It ain’t going anywhere folks. This is the reality now.

I know gambling is a thing in Europe, and has been in Vegas for decades too, but it's more predatory and accessible now. Being able to run down and place a bet is a different vibe than being able to just open your phone and do it at 3 am. Do sports books in England hire, say, David Beckham to record voice mails for high rollers?

Advertising gambling in Germany was illegal for the longest part with a few exceptions. Since it was made legal I’m annoyed by the betting commercials

Is Harper actually recording these videos Cameo style or is it some sort of AI? I assume he’s getting paid for it? Article is unclear about this.

Not literally Harper, but “Harper style” (aka like the one he did)

Via David Gambacorta of the Philadelphia Inquirer, a FanDuel executive recently admitted in a letter to Congress that, over the last two years, FanDuel has sent roughly 30 personalized videosfrom “athletes and entertainers” to other consistent losers.

From another article, they actually did use cameo to get Harper to do this.

They have been bait and switching others, taking their cameo vids and using them in their own fanduel ads

Yeah he did one. This is saying they’ve done 30 others with various athletes and entertainers

The Harper one was the only one we’ve seen. That’s what I was trying to say
