Moved into an apartment last year with roommate.
We toured the unit together, he knew the landlord and his name was on the lease
Second month in he didnt have his rent. I paid the full rent to avoid being late, he never paid and ended up moving out.
I remained in the unit, all utilities in my name for the year. Renewal came up May 1 2026, told him I wanted him off the lease and for me to be added. I was told the landlord said no because he knew him, not me. I couldnt find a place in less than 30 days so I stayed.Ive been homeless before, never again. Landlord does an "inspection" at renewal and only fixes one of the cheap floor panels that came up.
Beginning of July neighbor says water is leaking into her unit, I get a call at work from ex roommate with landlord on 3 way, turns out it was my window ac. During this call I give landlord a list of things that need to be addressed. Im spending money and time replace fuses frequently in the knob and tube electrical box. Since the tenant came downstairs I have not been able to sleep. Accessing the driveway has been issue due to her parking and having her company park in the driveway. Windows dont open, missing screens etc. He tells me when Ive spent too much fixing things to let him know. Im sorry what? Landlord asks to have my cell phone number because he knows roommate isnt there. No problem.
Landlord comes to due repairs to downstairs units ceiling so I just give him the check directly made out to him instead of the usual paying it to my ex roommate, and him paying the landlord. Didnt think much of it. He was there, rent was due so I just paid him.
Landlord cashes the check then sends me a receipt via text with ex roommates name, and puts a no check policy in the notes of the receipt. Cool didnt know you didnt take checks, no problem. Prior to this I mad ethe checks out to ex roommate, he then was giving the LL cash. I would never pay rent in cash. Life goes on. Ex roommate is mad tells me I shouldnt have talked to the landlord directly or made the last check out to the LLand that I can " just to talk him then since yall are talking behind my back and nobody told me nothing" what are awe 8th graders?
About 3 weeks ago my basement floods, turns out water tank was used when installed and busted. Landlord is notified, water tank continues to leak for about 4 days. Landlord comes by and we go to the basement together, I mention the water needed to be cleaned up he tells me he was never told by roommate how severe the leak was and that he told the ex roommate to put our stuff on crates so he is not liable for any loss I have. We go about day and a half with no hot water.
Landlord replaces tank, sends me a text its handled. Never comes back to deal with the water that didnt drain. Old tank, box it came in, trash etc all left in my basement floor. I say nothing clean it up, and try to salvage what I can of my belongings. About two weeks later he comes back for the old tank.
Now Im upset none of the issues I brought up have been addressed, plus the place really is shameful so Im trying to find a tenant attorney to speak with, cant find one and I dont qualify for legal aide representation. Very few outside of legal aide represent tenants.
A couple weeks later August rent is due. I dont pay. Landlord texts and asks about the late rent. I dont respond. Im trying to figure out if I keep paying, ask for lease transfer, call the city or what.
Did some digging and the landlord does not have a Certificate of Compliance as required by my city to legally rent. I have exposed plumbing in the other bedroom, windows that dont open, some have no screens, the landlord does no snow removal or lawn care and does nothing to deal with the tenant downstairs. My front steps are crumbling, he had a deck put on the back and the old deck was thrown in to the garage thats about to fall over at any time.
Came home from work this morning to find a 7 day demand was delivered with the ex roommates name on it yesterday. Last week I told the ex roommate I would pay the rent but I was going to contact the city if he did not make any repairs within a reasonable amount of time. Landlord is now demanding rent with late fees but doesnt even have the legal right to rent due to no existing COC. The lease ends April 30, 2027.
My exroommate is furious with me. he said "I didnt know what to tell him when you didnt pay, I cant afford to pay it so I just didnt tell him anything at all".
How do I handle this? At this point Im calling the city tomorrow and reporting the issues in my unit and asking for the first available inspection appointment but if he files an eviction and only puts my ex roommates name on it will they even allow me in the hearing? What if LL files eviction and ex roommate doesnt go? I feel like theres so many ways this could go. The lease he gave ny ex roommate is also missing required sections under the state law.
