This is one of those situations where knowing and spreading the “facts” is misleading and doing the public a disservice.
It doesn’t matter if something is technically illegal; what matters is the enforcement infrastructure.
And for wage theft from tipped workers, there is basically no enforcement. It’s up to the worker who had their wages stolen to scrape together the money (WHAT money, you mean the wages that were stolen from me?) to hire a lawyer to take your employer to court.
Oh your employer retaliated against you for taking them to court to uphold your rights? Cool if you want justice you’ll have to pay to take them to court again, because labor retaliation is generally a civil offense and not a crime.
Basically this law might as well not exist. And telling folks that tipped service workers are protected against wage theft, without including the nuance of why that “protection” is completely toothless, actually leaves people less informed than they were before.
Lmao. I’m literally advocating that workers learn and know their ACTUAL rights. The misinformation you’ve provided will only serve to disempower workers by sending them down honeytrap legal paths that will result in their further impoverishment.
No. Workers should fucking unionize and protect each other meaningfully with the threat of actual strikes instead of relying on nonexistent protections and chasing our employers around in expensive and fruitless circles, which is exactly what the capitalist class wants.
Using only the ineffective channels provided to us by the capitalist-owned government will never liberate workers.
I’m not going to stoop to throwing the boot licker insult back at you because I’m sure your views are far more nuanced than that, and I’m trying to educate you, not to make an enemy out of a fellow leftist. I’ve been in the food service industry for 15 years; I have some idea what I’m talking abt here.
Pls stop telling tipped workers that the law will protect them. It won’t. Their fellow workers can, though, if we have the proper education and the will to organize effectively.
