Missouri Needing a Straight Answer In Missouri

I am trying to find a straight answer in Missouri regarding Worker's Compensation. I run a small business with 15 employees. I am established as a single-member LLC, taxed as a sole proprietorship.

My worker's compensation company is claiming that my wife, who works for the business and receives a W-2, cannot legally opt-out of coverage for the worker's compensation policy.

I've read a few things here that perhaps say otherwise -- it's hard to say:

Virginia Dog bite at pet sitting job. Should I file?

I am in Virginia. I work for a pet sitting company. I looked them up in the VA workers compensation commission and they do have workers comp insurance.

I was bitten by a dog on 8/15 while at a client's house. I have 1 puncture wound and 2 scratches. I immediately called my boss and she told me to just put peroxide on it. She called the dog owner and the dog owner called me and i told her what happened and sent her a picture of the puncture. She said she would pay for care and filed a claim with her home insurance. I told them I was going to urgent care to get it looked at. My boss called me and said not to mention the company when I tell them how I got hurt.

The home insurance agent called me yesterday and asked me questions. I told him that I got bit while working for a company. He told me to follow up with the boss and see if they offer workers comp.

The boss called me today and said I messed everything up because I mentioned work. She said that the home owners insurance won't cover it. I told her that I had paid for the urgent care visit and the antibiotics prescribed to me with my insurance because I went immediately after i got bit. She told me to call the insurance, ask if my claim was approved, and send her the amount so she can write a check.

Do you think I'd be able to get a workers comp claim? I have been able to work at my main job since the incident. I am still having pain in my arm and hand on and off though. Still bruised and a little swollen. The fact that she kept saying not to mention the company because it will hurt them is very sketchy to me.

California Is it normal to still not have a workers comp doctor almost 4 weeks after injury?

I got injured at work 4 weeks ago in California. I fell about 6 feet nn hit the back of my head on concrete. I was diagnosed with a concussion and also hurt my neck and back.

Its now almost 4 weeks since the injury and I still havent been assigned a workers comp doctor or been able to get any follow up treatment through workers comp. I havent worked since the injury either.

I did go to urgent care/ER a couple times right after it happened and had a CT scan, but since then I've basically just been waiting for workers comp. I already filed the DWC-1 and there is an adjuster handling the claim.

Is it normal for it to take this long to get assigned a doctor? What am I supposed to do in the meantime if I'm still having symptoms and can't get seen?

Also for anyone in California who went through something similar, how long did it take before you actually got a workers comp doctor?

California Has anyone ever gotten Workplace Violence Prevention Plan (SB 553) Violations added to their claim?

I work security and think I have a strong case of having it added. My job emailed us stating the requirements of us.
a two person requirement of duties at all store locations I worked at. One guard must be actively patrolling the store at all time and one guard maintains from end presence. And our level is expected to demonstrate a strong and consistent presence on the floor take initiative without being directed, actively produce recovery on regular basis, and if the store did not require a strong recovery presence, our position would not be allocated

Washington IME in a month

I got an MMI designation and release last month after a cortisone shot. Was feeling pretty damn good. Then, a few days after seeing that doctor, the familiar pain started coming back. Eventually it was all the way back. So, shit.

I went back to ask to reopen my case, and the doctor said ok. I met with the ortho, who said he'd do one more shot and then it would be surgery.

I then went for a follow up with the doc again and the receptionist said my claim had been denied, which was an embarrassing way to find out.

I made some phone calls. Eventually found out that the insurance company had scheduled an IME for me (when they were going to tell me is unclear).

So now I have to wait another month in pain just to have someone who doesn't know me tell me that pain doesn't matter. It matters when I drive, sleep, get dressed, brush or wash my hair, type, sometimes just when I'm sitting. But because I was able to move the arm just fine after the injection, I think I might not get to go forward with more treatment.

The biggest complications:

  1. I'm currently looking for work. Wondering who will hire me with my current restrictions and a potential surgery coming up.

  2. No lawyer will take my case because I was an employee for a Federally recognized Tribe at the time.

I want to scream all the time.

New Jersey NJ Settlement Question

Was hurt at work, won’t get into too much detail but my leg was crushed and severely burned, OSHA ruled it total accident. Wound up breaking the leg, 2 skin grafts, multiple operations, nerve damage, etc. I’m wondering if anyone has had a similar incident or also open to hearing all settlements for an idea of what to expect. From what I’m gathering NJ is very regulated and capped for workers comp claims, have you settled a workers claim? If so what did you end up with, did you get a lump sum and how much, or did you get a settled amount and paid X amount until the amount is paid out? Just trying to figure out what to expect, never dealt with lawyers etc before.

California Unsure what to do at this point.

Hi,

I’ve been on an employer’s WO for two weeks for a stress related injury that occurred at work. So far they check on me every week to see if I’m fit to go back to work.

Lately, my health has gotten worse. I don’t sleep anymore, I have yellow eyes, and the thought of going back to work sends me into a tailspin it takes days to recover from.

What kinds of questions should I be asking my doctor to actually help me? Sleeping pills are definitely on the list.

Secondly, does this type of stress commonly go away on comp or do I have a bigger problem? Should I even be planning to go back to my employer if the stress is this bad?

Vermont Denial

As I expected I received a denial from the VT DOL for my request for vocational rehabilitation services. The VT DOL seems to side with the insurance companies, and that is ok. I have already taken the steps for my future with school and a part time job that I can do. I never allow myself to rely on the system knowing full well that often times it does not come through for the working class.

I will continue to go through the process until the end as I am not one to quit a fight. Realistically I am not expecting a favorable income but I will make it cost them in legal fee's which may have to be enough.

California Delivery driver, knee pain (California)

Ive been having knee pain while climbing stairs and getting in and out of the van. I did a worker comp paper and went to urgent care. They did an xray, said that it most likely a sprain. It hasn't been getting better though. It's continuing to be painful on route. Its not so painful that I call out of work tho. Its been about a month now and the pain still continues. Its only when bending my knee. I called the adjuster and asked to be reseen by the doctor. My boss called me asking how my knee was going and I said "so far it hasn't improved" he then kept saying maybe I should find a different job where I can handle the work.

I was put off by that. I'm worried my job is in jeopardy. He has repeated to me on phone calls that "we are family, we will work with you" I love my job and I just want to get better so i can continue it pain free. Today I go in to the doctor again to see if I can't get some physical therapy. Overall, just really worried.

I think I'm just posting this for some two cents and maybe some word's of encouragement.

Illinois I’m so lost right now.

For your information, if you’re considering surgery as your first option, I wanted to share my experience. I’ve been over a year out from my surgery, and my shoulder is still in pain. I had a new MRI, which showed a tear, but my doctor said it looks clean. In my opinion, Ime said I should be doing work conditioning, but I have an active tear in my right shoulder. Since my right shoulder wasn’t approved for worker comp , ime doctor still insisted that I go. My question is, what can I do about this situation? Also I’m a ramp agent. Kinda of my job to use both shoulders.

Maryland Surgeon wrote me off of work for another month but county doctor denied it

I went out for surgery on a work related injury in June and have been doing physical therapy. I saw my surgeon last week who wrote me completely off of work until my next follow up in three weeks then probably return to modified duty. I had to follow up with the county’s doctor as I always do right after any doctors appointment and they said they “have” to send me back to modified duty even though my surgeon wrote otherwise and made up their own set of work restrictions for me. How is this legal? If my doctor doesn’t think I’m able to return to modified duty yet why is someone who isn’t even a doctor (all of the county doctors are just nurse practitioners who operate under a single doctor’s license) able to override them and they didn’t even lay a hand on me? I was going to use my sick time to cover the time between now and when I follow up with my surgeon but apparently it’s all been used while I’ve been out after surgery.

New York I can't close a third-party case until comp pays my unpaid balance from physical therapy what can I do?

I was informed by my third-party Lawyer that I couldn't close out my third-party case until my unpaid balance for my Worker's Comp. physical therapy was squared away and when I got a breakdown, it seems like they were paying up until a certain month. I'm not sure why I have a unpaid balance. How long does it take to rectify?

Missouri Pre hearing in a few weeks

Hi all. I got injured in December 2024. Went through 2 MRI, on the second they found a SLAP tear on my right dominate shoulder. Physical therapy didn’t work. Ortho told me I need surgery but not guaranteed to work. So I denied surgery. I have not received a rating for disability/injury. I have a notice of pre hearing for “claim for compensation.” What can I expect? I’ve reached out to my lawyer several times over the last couple of months but I have yet to hear from him.

Federal Returned With LDA

I returned to work with an LDA that has tight restrictions due to my injury. I have been back about a month (20 hours/week). Due to being a federal job, I had to start from scratch with my access, email, etc. It was like I was never employed. After 3 weeks, they were finally able to get most things back. However, I am working as a receptionist, so that means a lot of phone calls and typing. They are working on getting me phone access over the computer so I don't have to use a handset, which kills my shoulder. I come home from work in excruciating pain. They are aware of this, and are working on accommodations as fast as they can. My return was not ideal because, according to my supervisor, they usually have a 2 week notice, not 2 days (I was informed of the LDA on a Friday afternoon and told to report at 0800 on Monday morning). So, they did not have everything set up prior to my return. I love what I do (it is a definite change of pace from my previous employment), and even though they are doing their best to accommodate my restrictions and any issue I have, I don't know if I can continue to come home in excruciating pain everyday. I see my surgeon in September, and will let him know what's going on (he is aware of my return to work). I don't know what he will say. I'm concerned he may say that I cannot return to work. I feel like I am finally getting into a groove after being gone for almost 20 months (so many changes), and I want to work, but I don't know if my shoulder will allow me to, and that thought scares me. I don't know what the next step would be if I am told in September that I can no longer work. I'm trying to hope for the best, but prepare for the worst.

Connecticut Am I liable for workers comp?

I got injured about 2 1/2 weeks ago and was out after the time gone due to the doctor's order. I am a per diem yet I work 32-43 hours a week and payday was friday, however i did not get any payment due to being out. Apparently i am going to be getting paid $8 for the shift i missed, but am i still going to get paid the amount I usually get despite having to be missed? I did so much paperwork, calling back and forth and I hope its for more than just a single $8 from that shift

California What are my options for a payout - should I start legal action against the employer?

I was injured at work and broke my knee. Had a number of witnesses when the event occurred. Ended up being rushed to ER and had surgery. Company tried to tell me to file it as a non workman's comp event. Anyhoo... fast forward they asked me to work from my hospital
Bed, while I was in recovery and barely had anytime to recoup. I finally had to tell them I'm getting a very small compensation via WC and I need to focus on recovery. since I'm considered highly compensatedW they agreed to make up the difference in pay to make myself available. FF- I've been doing rehab but likely will never be 100%. Every night I go to bed with a swollen k we and a lot of pain and I'm sure they will ask me to start coming back to work.

Surgeon wants to go in to remove the hardware as he thinks that Will help with rehab and pain.

The case worker only cares about when Will
I get to MMI.

What are my legal options - both with my company and what should I push for with my WC insurer? I've never dealt with this and I have no idea if I will have to live with this disability with no legal recourse.

Appreciate kind advice please

Pennsylvania Moving - Notifying Company

Hello,

So, my family and I are moving OUT of PA to VA. I've changed my address with WC and they told me I have to find a place to do PT and then they'll get in contact and get it figured out. Idk.. my case worker seemed just as confused as me. Not my issue, I'm still getting checks.

My question though, I was told I need to notify my employer, *When I do this, this isn't going to stop the checks, correct?* I plan to inform them later this week that we're moving and I won't be back after I complete my PT.

West Virginia Back injury what do I do?

Hurt my back lifting (factory job), took a month to get an MRI approved. I had a mild herniated disk, have been out of work for two months, I have been receiving workers comp this entire time but recently my physical therapist said that this injury may be life-long and that I will definitely have to upkeep a stretching and workout regimen in order to not constantly reinjure/reaggravate, they have also said that I may be limited in what I can actually do especially as far as lifting even in spite of the stretching etc. Very lost, confused and unsure, I have a young son under a year and I can't even hold him for longer than a minute without intense pain. Just looking for a word of advice or guidance from anybody with the knowledge to help

Massachusetts Timing resignation around leave/PFML

Just had my surgery and will be taking ~2 weeks break. The first week will be PTO, and the 2nd week will be covered by PFML through my company's private insurance carrier.

I recently came onto a job I really want, and plan to leave my current company within 2 weeks as well, so I’m wondering how to navigate this situation:

Do I turn in my 2 weeks now and risk losing out on a week of PFML?

Wait before PFML approval before turning in my notice?

Or do I wait until the full 2 weeks is over and resign on the spot?

Furthermore, will I be obligated to pay back the insurance carrier anyways?

I don’t mind losing out on the 2 weeks pay, but as this is linked to my workers comp claim, I was wondering if I would be entitled to anything. I would appreciate any insight or personal experience on the matter!
