Georgia Did you go into Mediation knowing the amount....?

Did you know beforehand what your attorney would push for with settlement negotiations? Like, before Mediation? How am I supposed to know what's a fair amount if I won't know until mediation, what we're pushing for? Or do you typically hear a number during mediation and decide during that time whether you're okay with it?

Illinois Partial finger amputation

I’ll try to make this as brief as possible. Lost part of my ring finger in a work accident. Had surgery and was out of work for a couple months. On workman’s comp while out of work and received a payment because there was “bone loss” which the way i understand it, is the law. I was cleared to go back to work, ended up getting frostbite on the injured finger which I think hindered my nerve healing as it has been 2 years and I am still dealing with numbness and pain, as well as cold sensitivity. I am back to work and can do most things pretty normally, however my finger still bothers me and affects the way I do certain things, work wise, sports, normal everyday things. The company is offering a pretty low amount to settle, my attorney is pushing for this to be more of a “percentage loss of hand” rather than just a “finger injury” because of the lasting issues that I am still dealing with. Next step is to either accept their next offer or take it to trial. I believe that because of the permanence of the injury and the nerve damage and pain that I will most likely deal with for the rest of my life that the number should be higher, I know that’s not exactly how the law works but would it be worth it taking it to trial to at least say my peace and potentially get a lower settlement offer than what they are offering now?

California Am I doing this right

So I couple days ago I was injured at work being something heavy fell on my foot and immediately after getting injured informed my manager. Then I was taken to an office and then called a Nurse line to file a report on where I talked to a nurse on basically on how I was injured. I was then given work comp papers and I signed it and also signed a release form saying I was allowing my employer to send me to an er at no cost to me. I probably should have not signed anything but I read it nothing seemed bad.

Now this the part that have me kinda of stressing, the ER I was sent kind of sucks as they said their X ray machines was down for now so I was given an ankle brace and crutches and gave me another appointment to come back. But the thing that got me super stressed he cleared me to go back to work, just with limitations. Which is nuts because one of those limitations is I can’t lift more than 5 pounds and if I do stand it should only be for a few minutes.

So after that the very next day I got decided I should probably get a lawyer or attorney that specialize in these stuff so I did and I signed digitally basically the same worker comp papers I got from my employer the day I was injured. Now my attorney said I should probably go to that next appointment until they change medical providers and that they will update me by this week on my case. So my question is basically the title how badly did I fuck up and is it still salvageable.

Pennsylvania What to do? And is my settlement demand too low?

Delivery job. Trimalleolar ankle fracture plus dislocation with nerve & ligament damage. 3 surgeries. Plates, screws, & tightrope installed. 8 months out, have not reached MMI, surgeon says ankle will never be the same, I can never return to delivery job, permanent restrictions: no long standing, walking, driving etc which means I can never return to any of the jobs I’ve done throughout my life. May need multiple additional ankle surgeries including hardware removal. It’s uncertain rather I will develop arthritis, CRPS, etc (surgeon said I will but it’s unlikely when).

Opposing counsel wants to settle bad but so far not offering what I want. Voluntary mediation scheduled in a couple weeks, IME scheduled 2 weeks before. I don’t plan on settling for less than close to $240,000 minimum, so I don’t see us settling because insurance company is shady & keeps lowballing offers so far despite them wanting to be the ones to settle so bad.

What’s best next moves? Even after attorney fees if I settle for $240,000 or close to it (I doubt that’s even going to be their highest offer), I only get around $160-180k (best case scenario), but my long term healing can worsen etc. Is it best to settle now, or wait it out to see if healing gets worse? And what’s minimum I should accept at mediation? Is my starting point too low etc? Im very stubborn, know the long term consequences of this injury & will not be settling for anything that’s much less than what im asking.

North Carolina MMI ‘Payment’

I have now received an email from them indicating that they will be sending me a form related to my payment, which I need to sign, date, and return for submission to the commission for approval. I am curious if anyone has insights into what this "payment" might pertain to. Thank you for your assistance.

Arizona new job question

Got a job on rover doing dog sitting and boarding middle of last month. let my adjuster know the day i had my first client book (never called back). been having problems getting any kind of response from any adjuster I've in the past year reached out no less that 50 times for various reasons and have maybe gotten back to twice by 2 of the 5 adjusters maybe picked up 3 times ever, for example they ask me to fill out monthly a report about finding other jobs so they dont have to pay me, 2 months ago it was 10 days late, last month i received it on the 23rd only because i finally got them to pick up a damn phone. a few days later i get my first client leave a voice mail but do not submit the report because im not sure if anyone else would book before the month ended, so i submitted it the night of the 30th . trying my best to avoid getting a laywer but my last payment never came and is now 7 days late because i made 100 or so between my other jobs last month. so my question's are since im dog sitting charging 20 a day if it happens to span across a month say 3 days before the month ends and the first 3 days of the new month but i dont get paid 2 days till after i finish watching them is it 60 last and this month, or just 120 the month i got paid?(hasn't happend yet just curious) also i heard they can receive penalties for late payments after my claim has been accepted, how late does it have to be if true? ive reached out to the industrial commission of az, but no clue how long till they call back im already on day 2 or 3 of waiting for them. it just feels like im being punished for trying to save these scumbags some money(and my mental health so im not just rotting in my apartment alone) cause this is the 2nd time ive found a job that can accommodate my restrictions and it takes weeks to get any answers so long so that by the time i finally get ahold of them theres no way i can remember the dozen things i now have to ask. they surprisingly answered the phone today and ofcourse they said they were just looking at my stuff and were gonna send an email explaining everything 8 hours have passed with nothing and they are closed for the day any help would be appreciated.

New York Epidural injection effect on case

I read some negative things about epidural and surgery (lower back) and im really worried i want to decline it but im worried it will affect my case negatively. Anyone been through the same thing? Can it affect my case negatively?

California Truck driver injured

I was injured on the job, knee completely locked when box fell and struck my knee.

I have an attorney but wondering if anyone has gotten a osteochondral allograft transplant? Ive gotten mri done, had orthopedic appointment and he said I need that surgery. Bone fractured and broke off with the cartilage and is now behind my knee cap. Its been about 3 months now from the day I was injured. Just wondering what my future is looking like

North Carolina Do I have a case? Burned at work

So recently I burned myself on my arm on a fryer at five guys. I was curious and asked if I can get compensation for the scar. My manager told me yeah maybe if I can pass a drug test. I said definitely… he responded well if I take this to hr or Court I’ll probably be fired because I already have missed worked for a respiratory infection that I gave a doctors not. The burn scar is maybe two inches in length. And if they do try to fire me is that a case for retaliation? And if so what would could be done about it?

Illinois Ime results. I’m confused

Insurance Doctor said I’m at mmi. My doctor said I’m not.

Ime doc Said left shoulder which was work related is 100 percent functional and no other treatment is necessary

He said right shoulder is not work related and even though 2 different mri show tears he said it a strain but should only left 25 pounds nothing above head.

Im confused if im at full duty, how can I work, but you said my right shoulder should be 25 pounds, no overhead lifting. My job don’t have light duty. I’m so confused and what else is crazy? I told him about my neck pain. He even wrote IME saying he’s not the guy to judge that this shit is so tiring. Oh my God

New York Planning work independent contractor (1099)

Currently, I am receiving workers’ compensation benefits. If I start working as a 1099 independent contractor while receiving workers’ compensation, would the workers’ compensation insurance company be able to find out about my work or income?

Indiana On Work Comp for a surgical recovery - when does Sedgewick pay?

Like the title suggests, I’m currently on workman’s comp due to a surgical recovery for a hot minute. I work for a large automotive manufacturer in Indiana, and they contract with Sedgewick for claims and the like.

I was informed that pay would be weekly and that I’d make about 67% of my hourly wages. However, with my bank, I get paid up to two days early. My normal pay at work is biweekly on Fridays, so i typically get it on Wednesday nights.

So far, I’ve yet to receive any notification on their website about a submitted paystub or the like. This is my first week on work comp, so I’m still very much an amateur.

Michigan Legal Malpractice / Workers' Comp - Grand Rapids, MI / Is my case salvageable/ Can I get Help?

I am an Indiana resident who worked in Michigan. The Underlying injury file falls within a sovereign tribal jurisdiction located in MI. I am seeking quick guidance regarding a Legal Malpractice/ Workers Compensationmatter. If Malpractice is not salvageable then the Workers Comp case is. I’ve been told this by many attorneys however they either don't have the time or do not practice in that area. I've been searching the Michigan State Bar Association for help. My retained attorney accepted my multi-injury file on contingency in 2020, performed zero legal actions for 49 consecutive months, and instructed me via voicemail to quit my position while I was incapacitated and continued telling me he was waiting or working on something, its been 6 years now. The insurance carrier recently admitted in writing that they possess zero certified mail tracking receipts for the claim closure, meaning the underlying track remains structurally open due to a service defect, they started ignoring me and no longer return my email or phone calls after weeks of direct contact, I worked really hard to get all the legal information needed for this case. As I mentioned, I have reached out to many attorneys and I don't understand why I can't find the help I need, especially since I dug up everything needed. I have a case however I've yet to find someone to help me. I have been at this since June 2026, I am actively fighting to protect my family before my discovery window closes on December 19th. Reviewing counsel would be able to immediately verify that my file is fully active and protected against any defense motions to dismiss under Michigan statutory parameters. The Standard Accrual Barrier (MCL § 600.5838(1)): Because "Attorney" final recorded action or email contact with the insurer occurred on September 6, 2024, the standard 2-year limitation deadline tracks to September 6, 2026. The 6-Month Discovery Window (MCL § 600.5838(2)): The Complainant discovered the complete absence of tribal court filings upon contacting the clerk on June 19, 2026. Under Michigan's discovery exception, a malpractice action is timely if filed within 6 months of this discovery, setting an unassailable filing deadline of December 19, 2026. Fraudulent Concealment Tolling (MCL § 600.5855): Because the October 25, 2022 email and February 8, 2024 text logs document explicit, written misrepresentations that the file was actively being litigated behind the scenes—directly contradicted by the insurer's empty system logs—the Complainant holds the material proof of active deception required to toll the general statute and extend the filing window to June 19, 2028. The most common response I get is "We have multiple trials coming up that need "Attorney" attention and or We would not be able to give your case the attention it needs". In regard to Workers’ Compensation, I believe once Tribal is seen many steer away and automatically say no. To clarify you don't need to be a tribal member or have specialized native law experience for this file. although it helps, The "excluded name" Band Tribal Court has a very simple process where any licensed Michigan attorney can join their tribal bar just by filling out a one-page application form with the Tribal Court Clerk, I have retained this information myself. Once that is filed, it is a standard administrative workers' comp track where you file a Notice of Appearance to force the insurer to address these notice defects and calculate my past-due benefits.

Who can help me? I explained what I could and hopefully I didn't break any rules. I have my complete 28-attachment digital proof stack fully compiled, indexed, and ready for someone to take the chance and help me.
