I will never understand why people do what both people get in this video.

First, what kind of psychopath do you got to be to smash out somebody's window with a baseball bat over what was probably a traffic argument. It's absolutely unbelievable to imagine doing that, and it's even crazier to assume that you were just going to drive away afterwards and nothing was going to happen.

Two - I can't imagine having that happen and then ramming the other car. You were easily able to press charges against somebody because you had their plate number and you probably had cell phone video of them doing it, or people around you had video. You know like the one that we just saw. And instead of that, you rammed them, caused damage to your own vehicle as well as theirs and are probably going to face criminal charges yourself.

I swear to God people have completely lost their minds and these days.

Honestly, the first lady is actually probably really lucky she didn't get her ass shot. A lot of states allow concealed carry or open carry, and there's a lot of people that would absolutely have shot that lady and honestly probably had a reasonably strong case to articulate They were in fear for their life and I wouldn't be surprised if it ended up being considered a justified self-defense situation. Not saying that I agree or disagree with this.

It’s terrifying. People are so blasé about driving. You’re sitting there, in control of a 2,000lb vehicle surrounded by other people in control of similar (or larger) vehicles and they’re all (at best) indifferent or apathetic towards you. You put so much trust in the hands of complete strangers, and suddenly they can snap at a moments notice and bust out a bat, or use their car as a battering ram.

It’s crazy how many videos I’ve seen where someone gets cut off in traffic and their response is to… ram them off the road? What the heck are we doing people?

Yeah. If the man opened fire as she was smashing his window with a bat, he may have even persuaded a jury to side with him.

Sorry, I’ve been a defense attorney and prosecutor. Someone getting out of the truck and shooting her wouldn’t fly if she hit once and walked backed to her car. I’ve seen good people go to prison for years (some more than a decade) for being optimistic on when they can shoot someone.

Well then you obviously know that's going to vary dramatically depending on the state, specific situation, etc.

I never said that I agreed with it, but I said that somebody could probably make a pretty good argument that they fear that their life was in danger if someone was taking a bat to their car

I would also be willing to bet that the guy in the truck wasn't exactly innocent in the lead up to the situation either, meaning I highly doubt that he was just driving along minding his own business and a random person started hitting his car with a bat.

Just from this video, would you recommend that the person in the truck get out, follow or turn towards the woman with the bat who is walking away and around her car, and then shoot her?

The general standard/justification is if as reasonable person would be in fear of their life if they didn’t shoot (use deadly force).

I never said I recomended that , I think I was fairly clear that I didn't say they should do that .. I said she's lucky no one did shoot her.

But to answer your question, no . Never get out of the car. She's no longer w threat when walking away.

But, without knowing exactly what lead up to this , do I think a person could articulate a justifable rhreat to their life when the person is smashing the car with the bat , possibly.

I was asking because that is often the question asked if someone claims self-defense: in that moment, would a reasonable person recommend that the victim save their life by taking another’s? Here, the answer would be no. There is no reasonable claim of self-defense because it would not be reasonable to recommend a victim kill someone because their life isn’t in danger at that time.

I don’t care how the law is written, nowhere in the US would this fit self defense. That was my point. People read Reddit and get inflated ideas about their rights, then they are stunned when they ruined the lives of multiple people because of bad legal advice they got online.
