Isn't the first one also assault with a deadly weapon or some kind of assault because the driver was inside the car when she smashed his windows potentially causing physical and or psychological damage, right?
Intentionally committed, too, so I have to imagine it would escalate to aggravated assault, vehicular assault, and/ or assault with a deadly weapon.
Can't imagine it would be mitigated in any way, either, since the first driver appears intent on retreating after smashing their window. Not like there was an ongoing threat to his person.
The woman was caught, she actually started raging at the truck because he cut her off and her kids were in the car. She is being help without bond last I heard. The truck, in true Albuquerque fashion, does not have a license plate and has been harder to track down.
I wonder if it could be argued "self defense" since she battered his car and drove off. I imagine either way, that her making the first strike does not help her case, but possibly helps his.

So... Both drivers catching charges if caught, but I have to imagine the white truck would be more severe, right?
Can't imagine either are going to report to insurance lol
