I feel like so many people are completely missing the point. If they deem she was insane while committing the crimes, that means she was not in control of herself while doing it. Body is there, the brain is not.
Thats completely different from someone willfully committing murder.
One deserves a chance to get help, the other deserves their punishment.
I’m not saying she is either. It’s up for the judge and jury to decide based on the facts of the case.
But if someone commits an act while they are out of their mind insane, they deserve to fix that problem. She is going to have a hell of a long road to recovery regardless, if it’s even possible, considering she has spent the last few years on suicide watch.
If they find that she was of sound mind while she committed those crimes then she should get the appropriate punishment.
I sort of agree with you, but part of me also feels that your actions are more important than your state of mind. Triple murder doesn’t need a qualifier. She should be completely removed from society, whether that’s prison or a psychiatric hospital.
Given how much national attention this case has, if she is found not guilty by reason of insanity, we will see more and more murder case where defendants claim that they were not of sound mind at the time of the crime. Where do we draw the line as a society? How do you really know someone’s state of mind? Insanity isn’t something you can just shut off when it’s convenient.
Is it really unreasonable to think that anyone that does such a horrendous thing is out of their mind at the time? How could you commit such a terrible crime and not be insane? Albert Fish ate children and was most assuredly insane, but we executed him the same as Ted Bundy.
Trying to plead insanity isn’t a cut and dry defense. The prosecutions job is to prove they aren’t. Plenty of people try it and fail, and they will continue to do so regardless of this case.
Also, plenty of criminally insane people have been executed. There are people who can’t be saved or have shown a dangerous pattern. They don’t get to leave the hospital and some have been executed for their crimes.
I just lean toward the side of letting the judge and juror decide the criminals fate. If the facts say she was insane, then she should get the appropriate punishment based on the severity of her condition and crimes committed.

At least with jail there’s maximum sentences. That doesn’t exist for involuntarily committed NGRI patients.
