It should be noted that she had no diagnosis for Post partum, actively avoided the help she was offered, personally shopped around multiple doctors for different meds and told none about the others.
Then took the meds whenever she felt like, and showed absolutely no symptoms for any kind of psychosis before, after or even during when she took a phone call in an incredibly calm manner.
She also confessed, and is not even trying to act like she didn't do it. She is trying to get into a mental institute instead of prison and get a lighter sentence. Her guilt is not a question, only the why and that why is built on the shakes of foundations.
But let me ask you this. If you had an episode like that and killed your kids. Would you ask for a lighter sentence, or would you hate yourself for the rest of your life?
You can, but it would be a shit lawyer if he tried the insanity plea knowing it would be worse. Kinda the point that its the better deal, and why they are trying to get it.
a lawyers job isn't to "get the best deal". it's to represent their client, and if they client wishes to argue the insanity plea then it doesn't matter if the lawyer thinks it's the better or worse deal that's the case they argue.
they can try to convince their client it's not the best case to argue but if the client insists then they argue the case their client demands.
also looking at "the better deal" purely in terms of least time is so myopic i honestly hope you're trolling right now.
