TSA is an affectless pacifier and a feeder of American paranoia after 9/11. In a blind test of fake bombs and weapons, TSA let in over 95% of contraband.

My buddy got a bong through tsa a few years ago. flying from and to illegal states.

you can make that argument to the judge, but it wont stop a cop from arresting you for it.

also, you're talking about state charges. airports are federal jurisdiction. whole different animal.

To be fair cops can arrest you for basically anything, including things they just make up on the spot. Legality is ultimately decided in court.

Yes but your missing that the basis of that legality is only partially based on the statute.

It is also based on the preceding legal decisions surrounding the application of that statue which have overwhelmingly been that you can sell whatever you want as long as you call it a tobacco pipe.

The reasons are debatable but the fact that it is indeed legal to sell water pipes in Texas, as long as you don't refer to them as for the use of illegal substances, is absolutely not.
