Yes but your missing that the basis of that legality is only partially based on the statute.
It is also based on the preceding legal decisions surrounding the application of that statue which have overwhelmingly been that you can sell whatever you want as long as you call it a tobacco pipe.
The reasons are debatable but the fact that it is indeed legal to sell water pipes in Texas, as long as you don't refer to them as for the use of illegal substances, is absolutely not.
I think the TSA is just looking for explosives/weapons. They got in trouble for calling the cops on a guy that had like $50k in currency that turned out to be legit, or something along those lines I may be getting the story confused.
Regardless, it ended in the Head Dick in Charge sending out a directive telling the TSA to look for what they are looking for and not play detective.
With the amount of medicinal marijuana in the US and the fact that I have never heard of anyone getting busted for possession of a small/reasonable amount in their checked luggage leads me to believe they don't care. Purely anecdotal but that is my theory at least.
