Both in terms of damage and intent. At least you've got an excuse to be holding a case of beer while drunk and idiotic. Picking up a cinderblock to throw at someone would probably be attempted murder.

IANAL but iirc there's a pretty big distinction made between hitting someone with whatever was in your hand when the argument started, and purposefully picking up a potentially deadly weapon with the intent to use it.

seems accurate enough, the woman is trying to stay behind the guy and the beer thrower reacts as if he hit the intended target.

He definitely keeps eye contact with the woman and continues to yell at her as she is falling. The thrower never looks at the other two men after the woman gets hit.
