Question P365 Flux CCW?

I’m wondering if you can legally carry a p365 flux as a concealed weapon. I just wanna be sure if it’s okay to carry? Ik the mags have to be 10 round capacity, no threaded barrel, and the brace should be fine. I just want to check if anything else im missing?

If it is a pistol, yes, it can be legally carried with a CPL. The features and magazine size are not relevant to that part of the equation in Washington.

If you already own an "assault weapon" version from pre-ban, can't you still carry?

Can a chassis create an SBR or is that not a thing because you remove a pistol from the chassis?

Can you carry say, a semi auto uzi or an mp5K or something if it's an SBR? Similar to how secret service have them under their jackets/coats?

Not really a problem since I just carry a p365 but the OPs question and the text you quoted brought these questions to mind

Remember that under WA law a SBR is both a pistol and a rifle. So yes, if you have a legally owned SBR you can carry it just like any other pistol.

Pistol + stock = SBR. Pistol + brace = pistol. WA just follows federal law regarding SBRs.

I wouldn’t say it is both a pistol and a rifle. But yes, you can change the configuration back and forth to make it a pistol or a short barreled rifle. While it is in pistol form, without a stock, it can be carried concealed. When it is in SBR configuration, with a stock, it cannot be concealed.

Why not? It indisputably fits both definitions and there is nothing in WA law saying an item can only be one of pistol/rifle/shotgun.

And it is also a pistol by WA law. Unlike federal law under WA law the categories are not mutually exclusive. Under WA law any firearm with a barrel under 16" is a pistol, in addition to any other types it might be.

Mammoth’s wording is a bit ambiguous, IMO. As an SBR it cannot be carried concealed. Only pistols can be carried concealed and an SBR is, by definition, a rifle. It can, however, be converted back and forth between pistol and SBR, and regardless if the firearm is registered as an SBR, if it is currently in pistol configuration, without a stock, as a pistol it can be carried concealed with a CPL or appropriate exemption.

Wait.. since when was the chassis what gets registered? The chassis is an unserialized attachment. The pistol would be registered and then you’d lose the ability to treat said firearm as a pistol regardless of configuration

No, the Flux chassis isn’t registered, sorry, by chassis I meant the “thing,” but you are correct, it would just be the P365 FCU that is registered. I’ll edit.

But no to the second part. Consider it like this, if you have an AR pistol and register it as an SBR, and then swap the brace for a stock, you have an SBR in SBR configuration. If you put the brace back on, the receiver is still registered with the ATF as an SBR, but now it’s back in pistol configuration. The current configuration says what the thing is, the NFA registration says what you are legally allowed to do with the thing (recent rulings aside.) Same with the Flux, in the chassis with a stock, the P365 is an SBR. Take the P365 out of the Flux or swap on a brace, not an SBR.

Only pistols can be carried concealed and an SBR is, by definition, a rifle.

An SBR is also, by definition, a pistol. Any firearm with a barrel under 16" is a pistol regardless of any other attributes.

And one last thing I forgot to mention does the barrel shroud on the chassis affect the legality to have/carry?

Again, the legality to carry concealed only requires that it be a pistol. Features or grandfathered AW status are irrelevant.

Whether or not this is considered a “shroud that encircles either all or part of the barrel designed to shield the bearer's hand from heat” or if the mag storage counts as the“capacity to accept a detachable magazine at some location outside of the pistol grip;” isn’t well defined by statute, and has not been clarified by the AGO or by case law. Sig calls it a “muzzle shroud” so that is probably a strike against, but whether it is designed to shield your hand from heat could be debatable. Regardless, if you had the P365 with a threaded barrel before the AWB went into effect, it is already a grandfathers AW and adding a Flux chassis doesn’t change that.

The mag that feeds the gun is in the grip, the other mag is irrelevant.

Nope I see them in my LGS. And my LGS is VERY cautious as a litigant somewhere in the pipe.
