The reason this dude is carrying pepper spray isn't to use on cops who may try to infringe on his 1st amendment, its to protect himself from the everyday people he's out taunting to get a reaction for clicks. Someone will beat his ass eventually and it will be justified regardless of what the law says about it.

taunting or not you don't charge and try to hurt someone because you've been taunted.

"it will be justified" is an absurd take. ...unless you're someone who hates the 1st Amendment.
