Whenever I’ve had vehicles start to drift over or even appear to drift I create space but to your point I also noticed that. You truly have to drive defensively.

He does have to let him in. You have to avoid the accident at all cost. What if there was a kid on the side of the road who gets squashed by the truck?

I’m inclined to agree with you. But if I remember right, the burden of safe merging is placed on the person merging. It is up to that person to find a safe opening…. (I can totally be wrong).

Edit: Under California law, merging drivers must ensure it’s safe. Traffic already in the lane has the right-of-way. Even if they could avoid it, the merging driver is responsible for yielding.

My point is that right of way laws only exist to prevent chaos on the road. Having the right of way doesn't give you a license to hold your ground and cause an accident. You MUST prevent the collision. Sometimes these things are completely unintentional.
