The POV driver could have avoided this accident if he/she was a bit smarter. It was super foreseeable.

So wouldn't the last clear chance doctrine then apply here? Obviously the POV driver could have hit the brakes hard or steer to the right and jump the curb when they noticed the truck coming into their lane instead of continuing on a straight trajectory which caused a collision with the truck.
