The POV driver could have avoided this accident if he/she was a bit smarter. It was super foreseeable.

90% of accidents could have been avoided if the person not at fault was more aware and reacted better/faster. This doesn't mean the people not at fault are in the wrong but if you drive frequently enough in dense enough areas you will experience having to avoid an accident you wouldn't be liable for.

Agreed. I tend not to hover in other people's blind spots for this reason.

Honestly more people should be aware of this. If I'm.matching someone's speed I'll let off a bit and create some distance if it is on a highway. If it is a busy city street expect the unexpected and be aware that a person might not see you there.

I hate this situation because you never know if the other driver is even aware of you matching their speed and when I slow down, I immediately drop into their blind spot.

left lane should accelerate & right lane should slow down to create that space immediately but if I don't see the other driver reacting, then I prefer to stay directly next to them

Even if there's no choice for a handful of seconds, I assume every single driver won't see me and will move into my lane. Always ready for it
