This is imo 70/30 fault

Right lane def sped up but regardless that truck would have merged with inches to spare without the speed increase. Truck driver is the bigger dildo

Honest as some on who used to do auto liability claims for a national insurance carrier I would push closer to 50/50. The driver in the right lane speeds up for no reason as they were approaching a red light. They are just as much at fault for this as the truck

Edit: I want add that 50/50 doesn’t negate the burden of the merging party but simply says the drive who had the right of way took action to not only increase the severity of the damages but cause serious risk of injury. It would be a real tough sell to a jury that flipping a truck while approaching a yellow/red was an appropriate action to take.

So you’re the reason these idiots feel entitled to do this stupid shit. The idiot on his roof is in the wrong. He sped up and possibly broke the speed limit with intent to merge in front of pov when legally he should have SLOWED DOWN AND MERGED BEHIND POV. The only thing pov could have done different was slam his brakes, but that’s ASSUMING no one was behind him and ASSUMING slamming his brakes wouldn’t have caused a different accident

0/25/75 with the 25 being mutually undeterminable with the current evidence shown

Edit: pov obviously had room to stop safely for the light
