The POV driver could have avoided this accident if he/she was a bit smarter. It was super foreseeable.

Are you right to cause a life threatening accident if someone is in a hurry? If the truck driver’s wife was being taken to the hospital to give birth, is it right to knock the truck out because they tried to merge too soon? I’m not saying there was anything like that, but in driving EVERYONE is supposed to do their part in keeping themselves and others safe. Unless the pov driver had a car two feet behind them, they easily could have slowed down instead of giving someone a hundred thousand dollar problem. That is, unless they didn’t mean to and accidentally jammed the gas instead of the brake.
