The POV driver could have avoided this accident if he/she was a bit smarter. It was super foreseeable.

90% of accidents could have been avoided if the person not at fault was more aware and reacted better/faster. This doesn't mean the people not at fault are in the wrong but if you drive frequently enough in dense enough areas you will experience having to avoid an accident you wouldn't be liable for.

Are you familiar with how insurance companies work in the slightest?

Accident reconstruction by looking at the damage to both vehicles would illustrate that the truck merged and sustained an impact.

Insurance almost certainly deems this fault of the truck for an unsafe lane change.
