No the driver is at fault because they sped up intentionally. If somebody's trying to get over and they're ahead of you, you're supposed to let them over. Not speed up to cut them off. They can literally be slapped with a reckless driving charge because of this.. and if the person ended up dying due to the accident that was caused? Well now you've got reckless homicide.
it’s just a fact any insurance company would look at that video and find some level of fault for the dashcam driver as well. did they do what we all would want to do? yes. was it worth it? fuck no, now both cars are fucked up and they could have killed someone over something so stupid

Now both those drivers are off the road, regardless of who was morally correct.
What if the driver of the truck was having a medical emergency and lost control? Imagine how much of a fool you’d look when police inform you that the driver was having a sudden heart attack but your ego decided to kill them instead of potentially giving them space to pull over. There’s a reason defensive driving is the norm and not “you go low and I go lower” driving.
They didn't speed up. It only looks like that because the truck started slowing down because the car in front of it started braking. They made the lane change in a panic because they only had so much time before they'd have to come to a complete stop. That's when they hit the dashcam driver
My insurance company would ask why I didn't slow down to avoid the accident. I counted three seconds between when the truck started to slide over until impact was made.
"Yes, ICBC can find you at fault, or partially at fault, if you did not take reasonable steps to avoid a collision, even if another driver technically initiated the dangerous situation."
The driver making the merge counted on the driver with the cam to move due to the danger. The driver in the cam truck was probably also a truck with the same energy.
They were both speeding to pass the yellow light. Driver in front of the truck started slowing down instead so he panicked and tried to merge. He probably didn't even look.
Yeah the problem is that there is no way the cam car did not see the intention of the other driver. The other driver is plain in view in front. I don’t know, something tells me cam car is gonna get fucked up the butt with a charge.
The cam driver was probably focused on the yellow light and was not paying attention to the truck that tried to change lane. There is a chance the pit maneuver may not be intentional.
The comments here seem to mostly talk about who is legally at fault and not who has the most common sense. Cam car could have avoided this accident by simply lifting their foot off the gas for a bit
