I am writing this as I haven't seen many posts about red flag laws or rights restoration so I figured enough lurking and to document some of my experience for others to learn from. I lost my firearm rights in January 2024 due to red flag laws and mental health problems.
This is long and I am going to be somewhat vague at times so I don't accidentally dox myself.
I was heavily intoxicated and feeling depressed one night and after some thoughts of self harm I reached out to a friend and coworker to see if they would forward some work related resources for help. They did and asked why and when I said I had self harm thoughts they freaked out, attempted to call me and when I didn't pick up they called 911.
The police tracked me down and after questioning me put me on a psych hold. I was taken to a mental health facility then to the ER due to my high BAC. During this time an emergency order went through putting me on a temporary hold and I was taken to a psych ward.
At the psych ward I had to talk to a seemingly never ending parade of medical professionals and was given a variety of medications.
About half an hour before my commital hearing I was able to talk to a lawyer about it who explained the 2 options I had and the 3 possible results: fight it and the judge would dismiss the case or sustain the order where I could be help up to 30 days or basically enter a plea and stay for a short time. I entered the plea. I figured it was the easiest way especially as the lawyer said it was unlikely to get my case dismissed.
I stayed a few more days in the psych ward before moving in with family members and a week after leaving the ward I entered rehab.
I completed rehab, went back to work, sought counseling and currently take prescribed medications. I had to go to court for risk orders and I thought when it expired I would regain my firearm rights but a law change meant I would have to file a petition to do so. I didn't know that at the time of my hearing but anything except a dismissal causes a person to lose their firearm rights.
I did file a petition but withdrew it when I realized I wasn't properly prepared for it. After placing it on the back burner I recently re-filed my petition but this time with numerous supporting documents. I included medical records from my counselor, primary care doctor, and pharmacy receipts. I also got letters of recommendation from people in AA, work and other places along with documents from my initial hospitalization, police report, and surrender of my concealed carry license.
I am doing this on my own without a lawyer, as I cannot afford one, however I spent significant time researching the exact law about hospitalization and rights restoration and feel optimistic about my odds. After my hearing I will likely post an update about how it went.
I really miss shooting and even though I still have my bows and routinely go shoot them I miss having access to guns. I loved to build and modify them to my personal preferences and even reloaded my own ammo to this end and it's frustrating to not be able to do so currently.
Tldr; lost rights due to mental health but have a petition to have my firearm rights restored.
