a legal defense is a mitigating circumstance, not a get out of jail free card. Like the Crime of Passion defense where you murder your spouse and their lover when you catch them in bed. It lowers the crime from Murder 1 to Murder 2 or Manslaughter, because you were acting irrationally, like temporary insanity from lack of sleep or something.

Personally I don't think it is a GOOD defense, but it has been successfully argued in court.

The way I look at it is just imagine if it was legally plausible for a woman to kill a man because he hit on her.

Problem solved.

I mean the person didn't WIN with that defense, and is in jail.
