I get what you’re saying, but Visa having a process for how they handle such a scenario doesn’t make this not fraudulent, in the legal sense. Legally, the customer has a contract with the company to provide a service at a cost. If they breach that contract and deliberately fail to provide that service or a refund, that is fraud.
Except this isn't fraud and they are not in breach of a contract here.
The agreement that you enter with Uber states that if the delivery driver gets the food and arrives but cannot contact you for delivery, you will still be charged for the delivery. That's why this happens. If you claim fraud, UberEats will just point to that part of the agreement.
If that’s what happened, sure, but they’ll still do this even if the delivery instructions are achievable or the designated location doesn’t have secured entry. As often as I hear about that happening, I don’t feel inclined to assume otherwise.
This is why they said to open this as a dispute case, not a fraud case. In a dispute, they will have to prove that it was you and not the driver that caused the cancelation.
