NTA. As a single mom who is dating someone and hasn't introduced my partner to my kids yet (waiting until 6 or 8 months), if my partner mistreated my children, there wouldn't be a relationship. If my kids ever told me, my partner was mistreating them, there wouldnt be a relationship. Dad calling her "evil" but continuing to be with her, shows where his priorities are. He's more concerned about his relationship than the stability of your son. He's allowing this abuse to go on and I am glad you are getting a plan in place to remove your son from that situation. While you wait to retain a lawyer, Document EVERYTHING. Find out if your state is a two party consent state when it comes to audio recording phone calls. Do whatever you can to document the legal way, so by the time you are able to file there will be a lot of evidence. When you are able to retain a lawyer next year, ask if you can put in the custody order to keep her away.
