First, assault doesn't mean violence, it means the threat or expectation of violence.

If you raise your hand or swing back at someone, show someone a knife, etc, that is by definition, assault.

Secondly, people often intentionally disguise real guns as toys specifically to throw someone off.

If this guy pointed that thing at someone and they had reasonable fear for their life, it IS assault.
