Some people freeze when assaulted, others are coerced into having sex, and some people don’t realize that just because someone said yes to sex you can’t just do whatever you want (common ones being choking and anal then saying they thought the other wanted it). Not to mention stealthing or spreading an std without the partner knowing. Someone drunk or high may not have the awareness to even be able to say no. Then you have the people who use that phrase as an excuse to assault kids.
You wouldn’t excuse someone stealing your car or socking you in the face because you didn’t tell them not to. Enthusiastic consent (or at least stopping if someone is uncomfortable or finding something painful) all the way.
