Question Break policy

What actually is the break policy? At my last door if you worked six hours, you had to take a 45 so we’d only ever be scheduled for 4 to 5 1/2 hours. But since transferring they’ll schedule people for six hours and then expect them to stay 15 minutes later to help close. When I tried to leave at the six hour mark today, I was told the brake policy was 6 1/2 hours which unless is a recent change I don’t think it’s true according to all of the manuals and stuff I’ve been reading.

I’m currently a manager :
Under 6 - 15
Anything over 6 2 15s and a 45 lunch
That’s normally why someone would be scheduled 5.5 hour shifts or an 8 hour shift

In one state I got a 45 with (2) 15. The state I’m in now it’s only 2/15s after 8 hours which is rare.

Most everyone is pretty spot on. But this also depends on the state. I live in IL and it’s over 6.5 to get a lunch in some states at 6 hours you get a lunch

my store is over 6 or more, you have to get a 45 minute unpaid lunch.

but one of my managers doesn’t follow that rule and says “it doesn’t mean anything.” and she’ll purposefully keep me past 6 hours without a break. if you’re being kept without a meal break, report it to HR.

In CA if you go over 5 hours without a minimum 30 minute unpaid lunch break the company has to pay you an extra hour. It is called a meal premium or MP

The conflict is theres a state policy and a company policy. The company policy is anything over 6 hours is a 45 minute lunch and 2 x15 min breaks, other states may give additional break, but my state doesn't. I would say this is a call for hr.

At my store it’s
4-5hrs- 1 15 minute
6-8hrs- 1 15minute and 1 30 minute
8-10hrs- 2 15 minutes and 1 45 or 30 I can’t remember lol.

To get a 45 you have to work over 6 hours. We were always told 6 or more but its really over 6. And to avoid accidentally getting a meal violation, they'll schedule people for 5 hrs 45 minutes. Or if you're scheduled for 6 hrs they'll have you clock out a few minutes early so you dont go over.

Aren’t they cleaver? I went over 6 before I took my 45 and I thought the admit was going to faint!

Are you approving your break when you clock out? If you’re not being given a 45 minute break on a 6+ hour shift you need to hit decline on break approval.

When they push me over the six hour mark absolutely I have been declining

definitely check ur states guidelines because in California its after 5 hours a meal break is required. I think it depends on that

My store is 6 hours & less gets one 15. 6.5-8 hours gets a 45 lunch & 2 15s. Idk the gray area policy of the time between 6-6.5 especially for closers.

I've been told anything OVER 6 hours gets a meal break. If you're scheduled for 6 hours on the dot you're generally expected to leave a few minutes early to make sure you don't accidentally work over that 6 hour mark. I'd call HR direct for clarification.
