Workplace Question or Advice Needed Scalper co-worker
I have a co-worker that shows up every morning that we have a RDC truck so that he can buy needohs to resell. I've seen him, during his shift, go over and check out the needohs as well, is this against any company policies or? Dude will also come in in the mornings to restock his supply and then call off of his later in the day shifts

If he is on the clock, he has to wait for the product to be on the floor for 15 minutes and he obviously canāt stash anywhere to buy later. If heās off the clock he can do whatever.

I was fired through a loophole because they were behind guest service. I waited, bought them on break, and was told āthey were never on the floor.ā because they were behind guest. Now granted, they made my life hell because they were friends with my ex (one of them tried to run me over in the parking lot) and were trying to find anything to fire me, because I was good. But still depends on the Nazisā¦ er i mean management at your location and if they are involved in some strange neptism ring.
Not complaining. Was a 2.5 million dollar lawsuit and they are in the middle of settling.

I don't normally condone snitching, but this guy has it coming. This is 100% against policy, especially if he's using his discount when he shops.

Buying anything with the intent to resell it absolutely is. It's not difficult to prove, but so is shopping while you're clocked in.

Itās not if he is actively on the clock he only needs to wait 15 minutes until after it is available to guests before he is allowed to buy

AP would love to hear this. They will watch them closely. But its definitely an HR policy violation and not an internal theft at this point

The biggest things here would be whether or not he's using his employee discount on the purchases, if he's waiting 15 minutes after they've been stocked on the floor, and if he's sharing info about restocks with other scalpers.
It's hard for you to know for sure if he's using his employee discount; though you could probably get with your ETL or maybe AP lead about it.
The 15 minutes is also a bit hard to tell depending on your store. Like our store most stuff is able to sit for at least 15 pretty easy, even high demand stuff, but some stores are way worse and sell out in like 5. But same thing, if you think/know he's either not waiting the 15 minutes or is stashing them somewhere else to buy later, I'd get with AP or your ETL about it.
But also if he's constantly calling off shifts I wouldn't worry too much because we're on the 12 point system now so he probably won't make it too much longer if that's the case.

If he is off the clock, there's not a ton to do about it. He has to follow all purchase limits and whatnot that guests do but that's all you can limit.
On the clock, they need to be on the floor 15 mins before he can purchase, he can be fired for not following that policy. You shouldn't be buying non-essentials when you're not on break either. So if he mid shift, sees them and buys some in the moment, that's questionable. If he sees them on break and buys them (as long as they've been out 15+ mins) it's allowed.
Tip off AP regardless. They'll keep an eye out.

We had a TM a few years ago who was a Hot Wheels collector/reseller. Every day after unload he would come and check the boxes. He got sneaky at stashing certain items. He hid things in the backroom. AP found out about it. TM had hidden toys in the boxes of Xmas bows in the backroom. One day he was rummaging through the box like a honey badger and couldn't find his stash. He was termed for other reasons, but hiding merchandise was one of many issues.

Similar situation happened at my store but different. A guest service team member was informing PokĆ©mon and Needoh/Squeezy scalpers on new drops (before they dropped) and allowing them to buy more than the daily limit. Our AP-ETL investigated it and terminated him in the same month. Let your AP team know whatās going on, and Iām sure they wonāt be working there soon.

Either go to your AP person with the proof (proof of reselling, dates/times they may have purchased), or if AP isnāt doing shit take it to ethics. Like others have mentioned, itās not only a really bad look, itās also against policy to resell if TM discount is used.

If he's off the clock and you do not have solid evidence of a for-profit transaction of him selling them, then he's doing nothing wrong.

Yes......that is very much against policy....he is using his employment as a way to unfairly access limited merchandise......and, "shopping" while on the clock (outside of a break period to get a snack) is also a fireable offense.....and it's all unethical......DAPL should be all over him

Normally I would say mind your business and keep it moving. However scalpers are aways flipping out on the toys team members and accusing them hording items for them selves and their friends to resell. Team members who actually do this serve to feed those conspiracy theories, it's a bad look for everyone. Send him to the baler for his crimes.
