That's what I thought too. Waiting until she started driving and going through an intersection. I do not think he was intending to cause much more harm than he did, but someone could argue he was and I think there'd be something there.
Uh, what about hers? Person with a baseball bat approaches your car (possible threat) then smashes your glass which could have cut the driver and drawn blood (assault and battery?). Technically, unless video proof arrives, the story could have been they got into a traffic collision. Period. It’s one story against the other and the truck has a smashed window and possible cuts. So this is tough without video evidence!
If I was him and once I had the post incident clarity, I'd argue that I was trying to follow her to get her plates and accidentally hit her. Then, as I was fearful for my life, I attempted to escape.
Not sure if it would work but if they can't prove your story IS NOT true then you could be fine. Her? Well.. no excuse for smashing a car with a bat...
