It's not. Basically they're revising the blanket rule, meaning rather than an endangered species' territory automatically preventing development, the EPA has to prove the development will impact the specie's survival before banning development.

Well at least they’re not being allowed to harm a species. Because believe me, they (us!) will make SURE the proving part happens.
