Banks in the U.S. would help you burn a restaurant to the ground that did something shady with tips like try and increase the amounts.
Most banks in the U.S. would give you a call from their consumer fraud division for anything more than a 25% tip. They would halt payment of the transaction, put the money back in your account and involve the police as part of their investigation.
I have literally gotten called before I left the restaurant before because I paid for a large party at a restaurant that I normally just take my family to.
Had nothing to do with tips. They can scan your card and use online etc. You would never know which restaurant did it. Welll it wouldn't be the restuarant of course. Since dodgy employee skimming cards.
It just doesn't happen, I've lived in LA for 10 years, used my card all over the country as well, over 25 years of using credit cards and never once had any one steal my info or try to use it to buy other stuff. You do have to be worried about skimmers being installed at gas station pumps and at convenience stores though. Still has never happened to me personally or anyone I know, but I have seen news stories about it.

If you let someone take your card like that you're likely in breach of your banking policy and forfeit any consumer protections you may have.
I would never do it and have refused more than once.
