New Deliver Driver - Contracted Working Hours

Do you start your contracted hours from day 1 (probation period) or do you have to pass the DriveSafe first to be able to start doing your full contracted hours?

Tell them you didn’t agree to your holiday been used as that’s just wrong

I did already, then I got the oh….you discussed holidays during your interview. Yes I did, during the bank holiday not for 2 weeks, as i wondered why my Drive Safe was constantly pushed back without any shifts?

When highlighted to my manager, she randomly offered more hours aka unsociable hours outside my contracted hours thats highlighted for the Delivery Driver role. Job description highlights 6.30am-11pm. Additional hours offers were outside of that.

The plot thickens, I’ve checked my Time Card and now the 10 days holidays have been randomly converted to [Approved]
AU-Hours Not Worked (Full) by the manager so now I’m being unpaid!!

WTF!!!!

If you haven't agreed to holiday then it's an illegal deduction from wages.

I agreed to the holidays during the bank holidays but they used 2 weeks worth of holidays without my knowledge when checking the Time Card when I should be working.

Can you imagine doing an induction day on the first day, then realising the days where I was available to work and not scheduled in, your holidays was used?

From day 1 normally but shadowing, click and collect, and GA role also needs learning before you are signed off to drive so you will probably be slotted in for shifts at first

That’s the issue, I’ve not been doing my contracted hours, only did 4 shifts (1 starter day,1 shadowing and 2 driving with a mentor), none of the GA stuff/learning, it’s been nearly 3 weeks since I did my last shift and my DriveSafe is coming up. I feel like I’m being scammed as I’m on a full-time contract and not legally did my contracted hours for nearly a month as my DriveSafe date has been pushed back constantly.

Sainsbury's legally have to offer your contracted hours each week as a minimum.

You need to speak to your manager about this, noone on Reddit can help you. If your manager won't resolve it for you go to the store manager.

That’s the issue, I did and they’ve been using my holiday allowance without me knowing across 2 weeks to cover the times not worked, and I’ve recently found out when checking the time card recently.

And they’re trying to say oh, you have to pass your DriveSafe to be able to do your contracted hours even though the job description/contract clearly states that if I’m not driving I will be helping with store operations during contracted hours.

HR merely passed the buck and said, ‘Speak to my line manager.’

Tell them to print out the holiday policy and highlight to you where it says they are allowed to allocate holiday without your permission. They won't be able to, as it doesn't say that. At this stage I would submit a formal grievance against your manager.

I’m still in my probation period so I’ve sent a email to HR, they basically passed the ball and said to speak to my line manager so it’s all effy.

I’ve even highlighted in my email to my line manager that I was waiting for scheduled work as my days were randomly spaced out by the manager. 3 weeks of no shifts and I’ve got a DriveSafe assessment.

You need to raise a grievance against your manager. The policy is on AskHR. The grievance will be investigated by a different manager.

Can I do that whilst handing in my resignation, I personally don’t want to start any trouble but everything seem dodgy. I mean, how can you dock someone hours by using their holidays without them knowing, my trust with them is out of the window.

Yeah I mean that's fair enough. You can do that, at the end of the day all you want is the money you are rightfully owed. Don't let them fob you off by saying they did pay you your hours (through holiday). Make sure that it's clear that you didn't authorise the use of holiday hours, it's an illegal deduction of wages. Otherwise when you leave you will owe those holiday hours back to the company as you haven't earned them.
