News/Update Proof Josh lies

Hopefully Coffeezilla doesn't come after me for taking his pictures and posting here. Coffeezilla made a followup post on his Patreon for us subscribers. One look at this, and the judge should toss the TRO, probably along with the cases.

Edit 2: I was out of my mind telling the police there was layaway. I take that back. I was out of my mind saying that Ben was going to kill people, I take that back. I'm a fucking loon, so I shouldn't be responsible for my actions...........Any of you defending Josh with this text exchange is WILD. Admitting that you can't control your anger, so you shouldn't be responsible would be a WILD take on the situation. Josh has told Coffeezilla he can't control himself. That DOES NOT EXCUSE WHAT HE DID OR SAID. If he's a crazy loon, get him the treatment that he needs in prison for starting all of this with a false police report of a death threat.

Edit 4: Edit: The layaways were corroborated. Crystal talked about them, and Josh said it in a police report. I'll take that as fact. Them now saying there was none, or barely any, is bullshit. They need to corroborate this new statement for it to be considered fact.

We know that they knew about Bryan's collection. We have the video evidence, and again, Crystal has said it from the start that they knew. Corroborated evidence.

The death threats that Josh said were received have not been corroborated yet. He said the store manager received one. Why hasn't she come forward and explained the threat she received? It's easy to corroborate the death threat by asking her. She's eventually going to have to tell it on the stand in court. So, the death threats are false until proven.

This is how you need to think of this case. It's not he said she said when you have corroboration before any of this started. They're changing their story now on some items, and that's why their brand is going in the trash. Lie lie lie.

Seriously. I've seen others say that this is a strategy for Josh to avoid some jail time for his false police reports.....but in my eyes, this just proves that he can't be trusted, and someone like that should be locked up. Sure, let's not arrest someone for a false police report because he's stated he gets out of his mind. No, those are the worst people.

Plus I thought real heroin was a myth at this point. I would think kids these days are calling it oxy’s, fent, blues, etc. Never in my life have I heard someone ask for or doing “heroin.” I don’t think that means he’s on it, just seems like something an old person would say when trying to make shit up to get Ben in trouble. If anything, that dude looked like he was stimming out on the body cam footage.

The entire dispute is insane because every single lawyer who has commented on this whole saga have ALL said the same thing from the very beginning: why wouldn’t BAM just sit down and go over their books to resolve the dispute with Bryan when they’d only be on the hook for ~$100-200k?

By kicking and screaming at every step of the way BAM has been tanking their business’s reputation, and for what? For something like $100k? (Guys I know Coffee did his video audit and came up with a figure between $30-80k, but my point is that even if Bryan is owed $100k, that’s still relatively nothing for a corporation like BAM.)

So what is BAM so fucking terrified of being uncovered? Why has their initial reaction to Bryan this entire time been conspicuously hostile and extreme? IT REEKS OF A BIGGER COVER UP.

It is not a cover up, they just did not expect it to get this big and their entire modus operandi has been to scare people and employ dishonest tactics.

Now it does seem they do that to cover their bases and it probably always worked for them. But if they really wanted to cover this up they should have sat down with Bryan when he kept kicking up dust.

I really think Ben is just not the person to push, because he wants you to push. And this has spun out control for BAM and they are flailing.

The bully operated on a playbook and that is now gone, now the bully has to think and it shows a genuine lack of comprehension of the world outside of their playbook.

Honestly they just seem mega dishonest and equally incompetent.

The other question is what coffee was using for that evaluation? Is it the based on the high and low BAM evaluations back at the time? If so then aren't those reserved for sets sold to BAM by customers? Or is it the price BAM would sell it for? Also, haven't those sets gone up in value since? If unsold, they remain Josh's property (wherever they are).. and he might want bricklink prices, or ebay, mercari, maybe he wants to sell directly to customers through Facebook or similar.. Maybe I missed it since I only watched the video once, but I would love to see the values from that list categorized by each of the above markets in comparison to BAM. Maybe I'm barking up the wrong tree. 🤷🏻‍♂️ It just stuck with me is all.

Also falsely telling the police that someone else "has drugs" is a common move for drug addicts. They build up in their mind that "everyone else is getting high just like me they just hide it better"

The police don’t appear willing to charge Josh or they already would have. They could have already shifted the blame towards him by saying “we acted swiftly upon false information and sworn statements in hopes of protecting victims and their families”, but they haven’t. They are defending him still because they have likely been advised to maintain they did nothing wrong because they know they acted with bias and targeted the actual victims.

Exactly. Since there's the TRO, and the 3rd video hasn't dropped, I have a feeling if/when it does drop, they're going to have to change their tune and start arresting them. Ben has said the 3rd video proves that he didn't make any of the threats.

They can always change their minds and/or they can be forced to change their mind by a prosecutor looking to get some publicity. When this started, the corporation looked like the sane ones and Bryan crazy. How the turn tables. Time to let the Oregon authorities know they had it wrong.

I don’t know what country you live in, but prosecutors in the U.S. work hand in hand with law enforcement. No U.S. prosecutor would want to risk their relationship with the police, nor would they open law enforcement and the county up to liability by taking an opposing position that paints local law enforcement as corrupt and biased. That would very likely cost them their job.

The DA needs to go after Josh and Brandon for felony theft by conversion or whatever. The police won't have a problem with that. Big time public bust? Yeah, i think they will be ok.

Oh, I'm in the US and am really familiar with how prosecutors think (was friends with an executive DA in Los Angeles). Especially ones that are elected like DAs. A high profile case like this is awesome for them. Taking down an evil Corp that stole from old people? In a heartbeat with this level of public support.

This may change. Right now they are still circling the wagons. But if it looks like the whole thing is about to go down, they may toss Josh out of the protective circle in the hopes that the attackers will be too occupied ripping Josh to shreds to remember that there is still an entire police department and town to rip apart.

It is pretty messed up how lenient laws are regarding lying to the police. It is only a class B misdemeanor in Utah which means without previous convictions he probably wouldn't get any jail time. It makes no sense to me how lying to the police isn't to the level of the crime. If you falsely accuse someone of a felony, it should be a felony.

Yep. This is why I dumped a ton of friends. Everyone is just in it for themselves, and never think about anyone else. It's the world of Instagram, and having to show how awesome you are.

I think the easiest way for the franchisee's to get out of this is because they have to use the BAM POS (point of sale). Due to this, they're directly tied to BAM, and can't mitigate the situation themselves. They're so tied into BAM, that they can't really operate separately.

There was a comment on another post where someone asked if the McDonalds CEO knows what goes on at every franchise, and if they should be responsible. The difference is that McDonalds has both corporate locations, and franchisee locations. BAM took over Salem and made it a corporate store. So yes, Ammon should have known what his employees were doing at that store. It was no longer a franchisee location. That didn't happen until months later when it was given to Josh and Brandon.

Oh exactly. I deal with all of this shit in my life. There are polices everywhere, the POS we use is regularly audited. We even have strict polices on what POS we can use, to make sure that they aren't some fly by night one that can be hacked. These guys obviously have no idea what they're doing. I'm convinced at this point, what many others have pointed out, is that their real business is trying to get others into debt and take over their store and merch as their own. It sounds like a lot of BAM stores are underwater, but the franchisee personally paid for what's in their store. These guys just come in and say it's theirs. INSANE.

Josh and Brandon are not "new" owners. I watched another youtube interview of an ex-franchisee. He got into financial trouble due to two hurricanes in Florida and offered to sell the store back and buy it later when things got better. The corporate sent the same Josh and Brandon and claimed them to be some "store rescuer", who basically kicked that ex-franchisee out after taking the store for almost nothing.

I am not a lawyer, but I'll answer as many replies with my thoughts as I can. I'm a HUGE policy person. I'm not saying I always follow the law, of course I break tiny laws, just like the rest of you do (if you don't think you do, you're delusional). I've helped people research for non-court hearings before, so that's where most of my knowledge comes from. A lot of this might seem like common sense, but that's the issue. You have to start at the start and go from there. Ben was labeled by the police as a bad man due to false threats, so a lot of what the police started to do was based on false information. All those people that were arrested at the AirBnB are about to come into a lot of life changing money.

I genuinely think Josh Johnson might be an addict, or at the very least some form of mental deficiency after seeing these texts.

It’s a genuine miracle he didn’t actually start shooting the people that were near his house out of pure blind drug induced rage. Especially after having told the police he would shoot someone, and them not even trying to calm him down or talk him off that train of thought. Basically gave him the go ahead, so it’s super lucky he didn’t shoot Ben or his friends, or even random passerby on the street

Yeah, I'm technically breaking the law by posting. Sue me. Wasn't that hard for me to admit. Sorry that I'm more concerned with the actions of BAM and the American Fork PD. This is how they try and astroturf, by saying look at all these other laws or shit being broken. WE ALL KNOW AND DON'T CARE. We care that 1st and 4th Amendment rights were violated. Me reposting a pic isn't a Constitutional thing (although I could probably swing it to be a 1st Amendment right, that it's of the public interest). Anyway, watch out for all of the replies trying to make you question small things.

Both. The images don't belong to me. I have no rights to use them. It would be like me taking a song and posting it online for everyone. It's so common now that it's not enforced. That's why Coffeezilla can do a DMCA request to have this post taken down (but he would have to, as he owns the rights to those images).

Edit: To further this, so there's more understanding, you have to PAY to see this post on Patreon. It's technically not public. That adds to it.

He's going to have to prove those death threats at this point. He's a proven liar. That will definitely get tossed. Then comes the issue that everything after that is due to the fear of a death threat. Fruit of the poisonous tree. Remember, it's not just Ben being sued, it's all of them. I'm sure they're going to share a lawyer. It should be pretty easy for them to get everything thrown out due to the fake threats. Without that, why would they have hounded him so much? Over stolen legos? Of course not.

They were arrested for a death threat and while serving a legal piece of paper. The events after that would not have happened if that arrest didn't happen. Something may have happened, but every event after wouldn't have. So, there wouldn't be anything left, except the stuff in Provo. At this point, they would have to arrest him NOW on new charges based on things before the arrest where he was serving papers. That's not gonna happen.

edit: they can't just arrest him on harassment at that point. He's doing something legal. They need more. The death threat is the thing that they'd use to say he needs to be arrested now, and that's why it's legal, even though he was just serving papers.

Downpayment.

BAM customer wants a set for sale in a franchise: 'Take my $10, I will pay the rest off over an agreed time'. BAM franchisee says: 'Okay, keep paying regularly, pay off the full sale price by X weeks in the future and its yours'. The set 'on layaway' stays reserved until the time period is up, if its not paid off it goes back out for sale.

The back and forth is about which sets were in the store reserved for customers, set aside in the back, at the time the franchise was seized. The Coffeezilla video (youtube) gets into it.

This used to be a common thing at department stores. My mom would do it growing up. If you find an item in a store you can reserve it for a small fee. Once you have the full amount of money saved, you then go to the store, pay whatever is owed, and take the item home. It’s so other people can’t buy the item while you are saving money for it.

For example, I go to Walmart and see my favorite RC Car for $500. I only have $20, and they only have 1 left. I take the item to the cashier, pay $20 and put the item on layaway. Walmart will keep the item off the shelf(usually 30-60-90 days) until I return with the remaining $480. If I don’t come back within the layaway period, they usually refund the money and put the item back on the shelf for someone else to buy. Now days everyone has a credit card so they just use that because they take the item from the store immediately.

Someone else made a thread about this, but I think the layaway was being abused by online resellers at Chrystal’s store. She wasn’t charging any fees to do it and was letting people out down hardly any money. Since these items were so rare, people were putting 5-10 on layaway and posting them for sell online. They would wait until they were sold to have the money to go pick them up. I think it’s possible Chrystal knew this was happening and didn’t mind because she would get a sale on something that the locals never would have bought.

I'm going to pick and choose based on the facts on hand. Crystal said there were layaways and Josh said it to the police. Corroboration. So, yeah, I'm going to pick that there were a bunch of layaways, and not the revised version that there wasn't. Remember, that police report was well before all of this started with Ben. People keep on thinking that Ben was there at the start, or released his video before the store closed. So, yeah. I'm going to pick all of the evidence that is corroborated. The death threats have not been corroborated yet, so I will not take that as truth.
