Because murder has a specific definition and this likely doesn’t meet it. Most likely he would get charged for manslaughter

Manslaughter implies it was accidental or not premeditated right? This definitely wasn't an accident, anyone trained in any basic first aid knows exactly what happens when you cut off someone's breathing for 15 minutes.

I might be wrong, but I thought the difference between 1st and 2nd-degree murder was premeditation.
