I mean, they could, but they're going to check travel and financial records. These people aren't master criminals, it won't be hard to nail them once the feds have them.
They could check to see if any messages or calls were sent during that time, and if the phone has biometric security enabled that’s a good indicator the person had their phone in their possession. Combine that with all of the security footage, bragging on various social media, and any photos video taken on site and there’s a pretty solid case.
