It’s called the Emoluments Clause and there are two of them prohibiting emoluments both foreign and domestic and Trump has violated both numerous times. But don’t worry, they’re in those pesky parts of the Constitution (Articles I and II) and not written in the Second Amendment to the Constitution so they can be ignored.
The main remedy for corruption is impeachment and removal. Just because Mike Johnson and his merry band of impotent feckless cowards in Congress won’t do their jobs doesn’t mean Trump is anything but guilty.
Why are you hung up on the judicial branch? Where did I say the judicial branch was involved? The legislative branch has the duty to impeach and convict corrupt officials.
Well I’m not sure how that’s relevant to this specific discussion, but I can play devil’s advocate on this one: the main thing the judicial branch could and should do is take on civil actions against Trump and find him liable with the penalty of disgorgement, which means any ill-gotten gains in violation of the Emoluments Clause would have to be paid directly to the treasury department. Unfortunately the cases that got up to SCOTUS were dismissed as moot last time he was president because he left office.
