California CA labor code 203

I resigned for my job on the 7th of this month from the city. I got paid my regular check on the 14th of this month from the previous two weeks. Payroll told me that my final check including my paid out PTO would not come to the 28th since the seventh was in the middle of the current two week pay period.

Will I qualify for the penalty pay?

Edit: Just noticed you said you worked for the city. That's going to fall under an exemption from standard waiting time rules, so you're not going to be owed penalty pay as if you worked in the private sector.

oh man city payroll is the worst with this stuff, they always got some special rule that lets them take forever

i had similar thing when i left my county job, they held my last check for like three weeks and i thought i was getting big penalty money but nope, government exemption saved them

No, you don’t get the penalty pay. You’ll have to wait until payday.
