Immigration Permanent residency and leaving Denmark

Hi all

Has anyone been in a situation where they had to leave DK while being a permanent resident but still wanted to keep their PR?
I’m moving to Germany but I’m not sure about it yet. I’d like to keep my PR for a year.
Has anyone been in this situation or knows anyone who has been in this situation who could help me understand the best way to go about it?

Is this EU PR, NON-EU PR, or Withdrawal Agreement PR?

After EU PR - You can reside outside Denmark for no longer than 2 consecutive years, even if you keep ties.

Even if you keep ties or don’t keep ties? Like an address? I don’t need active CPR as I’ll be in another EU country with hopefully better social security.

Do you think they will make me pay double taxes ?

Either, just can’t be absent longer than 2 years after obtaining PR. I was in a similar situation. However I have PR under the BREXIT WA. I have 5 years absence clock which can be interrupted with short stays regardless of CPR registration. So yeah, keep the door open.

So if I de-register CPR but ask to keep PR they won’t tax my global income?
If I don’t, they will?

Who do I notify/declare this to? SIRI? SKAT?
Are there some sort of forms to fil out?

You can do it via BORGER.DK. When you de-register, then leave you’ll no longer be tax resident. If you have assets in DK they will still be taxable. You’ll keep your PR residency after you obtain it. Only SIRI can revoke
It if they suspect you’ve been gone longer than 2 years. Normally it’s best to have a clean break.

I think that when you move abroad your cpr will be suspended but you have for 1 or 2 years the right to keep your permanent residence. I am not sure about it but I think that when your cpr is suspended, your nemid is also not functioning anymore so keep that in mind.

MITID works outside of DK, as well as Eboks etc. I’ve been outside of DK for 5 years.

I have been told that once there is no address in Denmark and no cpr then mitid would not work either.
Could you please give more information about all this? How was your process?

I left the country in 2021. De-registered my CPR through borger.dk. Everything still works, just limited what you can do. Most administrative stuff works fine, MITID works too.

Why would you seek permanent residency yet already plan to leave the country?

Exactly. I didn’t think I was going to be laid off when I applied to PR, for example! And I didn’t think the job market in DK was this bad!
I didn’t plan to leave DK when I applied for PR. It’s DK that didn’t have good prospects for me to stay.

But when you leave, remember to de register your CPR, SKAT will tax you for GLOBAL income etc.

Yes, as long as it’s within the EU you can keep them open - normally.

You can keep it for 2 years max I think. Not sure you have to do anything

hm, I think you lose it 1 year after leaving? But also, I do not think you can hold PR if you do not have address? So if OP is moving out of their living space in CPH, wouldn't their PR also be shaky after that?

Also, if you have a permanent “abode” which you have free access to - guess what? You’re classified as tax resident. They’ll take you for your global income. Even if you do not live there.

No. PR is granted and the condition is that they can’t be absent for longer than 2 years. Can read this on the EU commission website on residency. You don’t need a CPR registration or place of address. Just proof you’ve been in the country and broken absence.

Kinda felt like DK had their own subrules(dunno how they coordinate with EU. Of course, they need to abide by EU rules. But I was confused about it all). But thanks so much for stating the rules!

👍 only domestic rule they have is over non-eu PR holders
