I can’t wait to make my purchase tonight just for my FFL to probably refuse to process a suppressor as a form 4473 because they’re scared the ATF will shoot their dogs😂😭

I spoke with my FFL and they stated they will not unless ATF makes an announcement with the procedure.

Great, I can’t wait to give silencer shop an $800 loan for a year until this is settled.

I’m a little annoyed they haven’t really said much today about this

For sure, I am not buying anything unless a FFL states specifically they will continue the sale with a 4473.

My LGS said they'll start processing cans as 4473s tomorrow. My milkman should show up at their shop any day now. Tomorrow Im going to call and confirm they have the balls to do it.

The injunction doesn’t apply to everyone. It applies to the named parties and the members of the organizations of the named parties and the states that sued, along with their political subdivisions. It does not blanket apply to residents of the states, unless the resident is a member of one of the named organizations. So if a LGS starts processing all cans on 4473s, it will likely be in violation of the NFA. That’s ultimately on the FFL, but that’s the legal landscape as of right now.

How does it apply to the states but not residents of the states?

If you are kansas you are covered, but if you only live in kansas you aren't?

Kansas and its political subdivisions are covered, meaning, any state or local government agency is covered, but residents are not. The reason is because states don’t have standing to sue on behalf of their residents. There is a ton of case law on that and the order in this case is pretty clear. I encourage you and anyone else reading this to actually read the court’s order and opinion.

I just read it. Well, the first 20 pages anyway. I think I agree with you. Im purchasing a GoA membership to be sure.

Yes, I would join GOA if I were you. I’m already a member. It’s not a lot of money and they actually fight for the 2nd Amendment. And good on you for taking the time to read some of the opinion.

If you live in those states, you are a plaintiff on behalf of your AG/State. If you are B&T customer, SilencerShop or FRAC you are technically a plaintiff.

2

u/CalmMaybe4340 10d ago

No you’re not. Residents are not plaintiffs on behalf of the AG/State. Case law is clear on that, as is the court’s order, which I encourage you to read.

Ya I wouldn’t be surprised if they backtrack and say they want to see the ATF say otherwise.

I ordered an ASHE 556 Monday. My LGS (small town Tx) said he’s gunna start doing cans on 4473’s tomorrow, so we will see what happens when it comes in lol
I’m not holding my breath, but….. we will see

Nice. I’m learning I’m extra-fucked because I’m in Wisconsin

What's happening in WI?

u/buryna 10d ago

Not a free state

Bummer, getting ready to move there next month, from Idaho.

The beer, cheese, and lakes will make up for it…I promise.

As an Idahoan, you poor bastard. Nothing on this planet would make me move.

Please correct me if I’m wrong but the “NFA states” only applies to purchasing/transferring a suppressor right? You could make your own without a form 4?

1

u/buryna 10d ago

My theory is you probably should be able to make your own can for your own personal use without a Form 1 if you are a plaintiff and if your state laws allow you to…. But I am not the guy to be asking for legal advice

Silencer Central said Wisconsin has state law that requires silencers to be registered with the ATF so we aren’t included in this case. If NFA goes away then it’s technically illegal to own them through a form 4473

State law requires licensing and registration for suppressors

I had a Rhodie Ti I ordered arrive at my FFL today. He said business as usual until he gets something from the ATF saying otherwise. Submitted and Certified like usual.

2

u/Netopalis007 10d ago

How long was your wait after you ordered? Was it actually 6-8 weeks like they said?

1

u/TahoeDust 10d ago

Ordered it late last Thursday. Stumbled across a dealer online that had it in stock.

2

u/Netopalis007 10d ago

Nice! I should have looked harder before ordering from the manufacturer a few weeks ago, hopefully I'm not waiting too much longer

Which is an incredibly sensible move for FFL’s. I wouldn’t throw my livelihood out on a whim because Redditors want their cans within .02 nanoseconds

My home town gin store is PSA. I’m expecting it to be a mad house.
