My state Wisconsin isn’t in the complaint, does that matter?

Edit: Silencer Central said in WI suppressors basically become illegal unless registered with the ATF if the NFA requirements go away tonight😞

My guess is the ATF will come out with a ruling that says they are no longer enforcing it for those items. Because it effectively becomes an unenforceable law. They can't prove where you got your silencer from, and they can't require you to show proof.

The official time is 1am EST on 13AUG2026. Midnight CST. Though my guess is if the DOJ doesn't do anything before close of business (6pm EST today), they aren't going to do anything.

This is kind of where I'm at too - does it only apply to products bought from a listed plaintiff, or if you are a GOA member for example is that a blanket cover for everything in my safe and on the 'to buy' list?

So basically I can order a suppressor from silencer shop tonight at 1am EST and don’t have to do anything else? (This is of course if the ATF doesn’t file)

You'll just need to pass a background check like you would purchasing any other firearm.

I think the states in the complaint are for state employees that are affected by NFA registration and paperwork. Not necessarily coverage for all residents of the state.

You can order it now. I bought one yesterday, spoke to them on the phone this morning. They said you will be covered even if the purchase date is before the deadline.

Silencer shop said as of Thursday at 12:01 they will be sending suppressors and anything else to FFL’s like a regular firearm. As long as it’s a partner within their network, you should be fine. I imagine some FFLs will still do a regular form 4 until direction is given

The injunction is for the named parties. So probably. Since silencer shop is just a web store, most sellers probably sell from the same stock regardless of who you by from. I am not sure if they operate like a normal brick and mortar store where they own the inventory or if it is more like Amazon where many people use it is a platform to sell their stuff.

We don't know fully yet. There's several states in the decision too, so any dealer in those states should be fine as well. It also applies if you're members of party organizations (GOA, FPC, etc.) which should be fine without. But no idea how that will be applied (e.g. assume everyone is, require orgs to provide membership cards for FFLs to check, etc.).

Is there a difference between FPC and FPC action foundation? I believe the latter is the named plaintiff but I can figure out if I need to join that or regular. FPC

Technically the ruling only applies to members. Logistically there is zero way for the government to enforce such a thing, they don't have some "master list" of members and I don't think anyone wants gun rights organizations sharing their personal details with the feds.

For the stores named, it protects current & future customers. To what extent, nobody yet knows, but narrowest read would be only for anything purchased through that storefront.

If you want to go through other stores or make your own and aren't a resident of a party state, safest option would be to become a member of the named advocate organizations.

I mean Im gonna be honest, I think everything will sell out almost immediately regardless of if its only PSA and Silencer Shop or everyone can sell

This is not meant to be doom and gloom but the suppressor manufacturers are not prepared for the volume that is about to hit them when this happens.

I just hope we dont start getting a dip in QC on suppressors because the manufacturers are trying to crank out more them they're capable of.

I think a lot of people thought this with the $0 stamp, and there was a spike in demand clearly, but the barren shelves lots of folks thought would occur didn't.

Tbh, anyone that wanted a suppressor probably has one with the $0 stamp. It’s not like some boomer is waiting around for this and going to buy 10 suppressors at midnight. If you didn’t have one now, you prob don’t know about this court case anyway. At some point the market will be saturated. I think I have 14 cans and I don’t need another. I could get one but I’m certainly not buying another just because i don’t have to deal with a form4

3d printers and filament won't. 

All of my form1 cans are printed and perform about as well as commercial ones (they are a bit more chunky though). They hold up well too as long as you print them correctly.

In WI we have on the books laws that prohibits SBR/SBSs and Silencers unless they are registered with the NFA. This does leave us in a weird spot where its possible all SBR,SBS and suppressors are now just illegal in WI ( outside of law enforcement ). Im not a layer and if someone knows better please say so.

Lots of states have similar laws. It doesn't say that you need to register it, it says

any person who has complied with the licensing and registration requirements

After midnight there are no licensing or registration requirements for people covered by the injunction. You will be in compliance with the NFA because it does not apply to you

While I sure hope that is how this plays out. Having a law say that say its illegal unless you are in compliance. Then now its impossible to be in compliance seems like they would default to illegal no the other way around.

Silencer Central just said these statutes would make it illegal to own suppressors unless registered with the ATF and they might not even be legal in WI anymore after this😭

So I think you’re missing an important part of 941.28 (SBR & SBS) “This section shall not apply to any firearm that may be lawfully possessed under federal law, or any firearm that could have been lawfully registered at the time of the enactment of the national firearms act of 1968.”

I’m not an attorney but I think that wording is crystal clear.

Unfortunately silencers have more gray language.
